A RESOLUTION APPROVING THE RECOMMENDATION OF THE WEST
MEMPHIS UTILITY COMMISSION FOR IMPOSITION OF CIVIL PENALTIES
AGAINST THE COLONEL'S FACTORY OUTLET OF ARKANSAS, INC., FOR
VIOLATIONS OF ITS INDUSTRIAL WASTEWATER DISCHARGE PERMIT.
WHEREAS, the West Memphis Utility Commission is duly
. authorized to conduct show cause hearings far violations of
Ordinance 1214, as amended, and industrial wastewater discharge
permits issued pursuant thereto; and
WHEREAS, on August 1, 1994, pursuant to proper notice, the
West Memphis Utility Commission held a show cause hearing
regarding alleged industrial wastewater discharge permit
violations by The Colonel's Factary Outlet of Arkansas, Inc.; and
WHEREAS, The Colonel's Factory Outlet of Arkansas, Inc.,
appeared at the hearing by and through Charles Cross and did not
contest the violations or the proposed enforcement action; and
WHEREAS, the West Memphis Utility Commission voted
unanimously to adopt and recommend the enforcement action as
presented by the Industrial Pretreatment Coordinator for the
imposition of a civil penalty in the amount of $3,614.00, plus
the costs of the hearing;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT the City Council hereby
approves and adopts the recommendation of the West Memphis
Utility Commission for the imposition of a civil penalty in the
amount of $3,614.00, plus costs of the show cause hearing,
against The Colonel's Factory Outlet of Arkansas, Inc., for
violations of its industrial wastewa/t~er di-sic-barge permit.
