AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR
ECONOMIC DEVELOPMENT SERVICES, APPROVING A CONTRACT
BETWEEN THE CITY OF WEST MEMPHIS AND THE WEST
MEMPHIS CHAMBER OF COMMERCE, AND FOR OTHER
PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of
competitive bidding in exceptional situations where such procedure is deemed not feasible
or practical; and
WHEREAS, there are many items necessary for the City's use where competitive
bidding is deemed not feasible or practical; and
WHEREAS, the West Memphis Chamber of Commerce and the City of West
Memphis have proposed an agreement whereby the Chamber of Commerce agrees to
provide economic development services for the City and the City agrees to provide
funding for said services; and
WHEREAS, it is hereby found and determined that it would not be feasible or
practical to conduct competitive bidding for such services;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
1. Competitive bidding be waived for the employment of the West Memphis
Chamber of Commerce to provide economic development services to the City of West
Memphis. Competitive bidding is being waived for the reason that competitive bidding of
these services would not be feasible or practical and the West Memphis Chamber of
Commerce has unique knowledge and experience in providing such services for the City of
West Memphis.
2. The 1998 Agreement between the City of West Memphis and the West
Memphis Chamber of Commerce, for economic development services is hereby approved,
and the Mayor and the City Clerk are hereby authorized to execute said Agreement on
behalf of the City of West Memphis.

Agreement
This Agreement is entered into this day between the City of West Memphis and the
West Memphis Chamber of Commerce;
WITNE5SETH:
In consideration of the covenants and agreement set out herein, the parties
hereby agree as follows:
1. The West Memphis Chamber of Commerce shall provide to the Office of
Economic Development the following services connected with economic
development:
a) Serve as a point of contact to all walk-in and call-in inquires. Refer all
inquires to the Office of Economic Development and provide basic statistical
information pertaining to the City. Office of Economic Development approval
required concerning the packet used to respond to inquires. Prepared and submit
monthly report (due the second week of each month) that shall include:
1. Summary if inquiries (form provided by Office of Economic
Development).
2. Copies of inquires if by mail and log sheets if by phone (form
provided by the Office of Economic Development).
3. Updated information packet used for response.
a) Assist in the development of promotional material for
West Memphis.
b) Along with the Office of Economic Development
participate in the planning, development and implementation
of special events pertaining to ezisting business and industry.
Participate and assist with the Manufacturers Association.
c) Assist the Office of Economic Development with providing
information, accommodations and services to visiting
prospects.
d) Quarterly reports shall be submitted to the Office of
Economic Development concerning activity related to
economic development by the West Memphis Chamber of
Commerce with a quarterly invoice.
4. Serve as a point of contact to handle screening and employment
opportunities for new business and industry locating in our city.
5. The Office of Economic Development will have access to the
Chamber's meeting facilities. Advance notice will be needed to assure
availability.
6. The Mayor shall serve as an ex officio member of the Chamber
Board of Directors.
7. In consideration of the above services to be provided by the West
Memphis Chamber of Commerce, the Office of Economic
Development agrees to provide funding to the West Memphis
Chamber of Commerce for the amount of $10,000.00. These funds
will be payable at the rate of 52,500.00 per quarter. This contract
shall be in effect January 1,1998 through December 31,1998.
