ORDINANCE NO. I8'jCj
AN ORDINANCE VACATING A PORTION OF COX AVENUE IN
WEST MEMPHIS, ARKANSAS.
WHEREAS, a petition was duly filed with the City Council
of the City of West Memphis, Arkansas, on the 13th day of
November, 1998, asking the City council to vacate a portion of
Cox Avenue in the City of West Memphis, Arkansas, as
hereinafter more particularly described; and
WHEREAS, after due notice as required by law, the City
council has, at the time and place mentioned in the notice,
heard all persons desiring to be heard on the question and has
ascertained that the portions of the street hereinafter
described have heretofore been dedicated to the public's use;
have not been actually used by the public generally for a
period for at least five years subsequent to the filing of the
plat whereby they were dedicated; that petitioner is the sole
owner of the property abutting upon the portions of the alley
and street to be vacated; and that public interest and welfare
will not be adversely affected by the abandonment of such
portions of said street.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
Section 1. The City of West Memphis hereby releases,
vacates and abandons all its rights, together with the rights
of the public generally subject only to existing utility
easements, in and to the portions of the street described as
follows:

a) All that portion of Cox Avenue which lies east
and adjacent to the north 50 feet of Lot 78, all of
Lot 93, Eighth Street, Lot 94 and Lot 109 of Hulbert
Heights Subdivision to the City of West Memphis as
shown by plat recorded in Plat Book 1, at page 40 in
the Clerk's Office of Crittenden County, Arkansas.
All of the above described property is located in_
the west 720 feet of the SE 1/4 of Section 13, T-~-
N, R-8-E, Crittenden County, Arkansas.
Section 2. A copy of this ordinance duly certified by
the City Clerk shall be filed in the office of the Recorder of
Crittenden County, Arkansas, and recorded in the deed records
of the County.
