A RESOLUTION TO CERTIFY JUDY GOBBELL AS THE CITY TREASURER
AND TO RATIFY THE ACTIONS OF DAN CRAFT TAKEN IN THE
CAPACITY OF CITY CLERK-TREASURER.
WHEREAS, prior to the establishment of the position of
city clerk-treasurer pursuant to Ordinance 1565 of the City of
West Memphis, Judy Gobbell was the duly qualified and elected
city treasurer; and
WHEREAS, in the case of Burroughs, et al. vs. Ingram, et
al., case number E-93-08 in the Chancery Court of Crittenden
County, Arkansas, Ordinance 1565 has been held to be of no
force and effect; and
WHEREAS, the Constitution and statutes of the State of
Arkansas provide that elected officials continue to hold office
until their successors are elected and qualified; and
WHEREAS, as a result of the ruling of the Chancery Court,
no successor to the position of city treasurer has been duly
elected and qualified and Judy Gobbell continues to serve as
city treasurer until such time as a successor can be duly
`~ elected and qualified; and
WHEREAS, the official actions of Dan Craft acting in the
capacity of city clerk-treasurer should be approved and
ratified as the official actions of the City of West Memphis;
NOW, THEREFORE, SE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
1. Judy Gobbell is hereby certified as the city
treasurer by virtue of being the previously elected office
holder and that no successor has been duly elected and
qualified and she shall continue to serve in the position of
city treasurer until such time as a successor is duly elected

and qualified.
2. The official actions of Dan Craft acting in the
capacity of city clerk-treasurer prior to April 1p~ 1996, are
hereby approved and ratified as the official actions of the
City of West Memphis, Arkansas.
