AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR THE PURCHASE
OF AN ELECTRICAL DISTRIBUTION LINE FROM ENTERGY AND FOR
OTHER PTJRPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS, the City of West Memphis and the West Memphis Utility Commission are in
need of acquiring ownership of an electrical distribution line owned by Entergy ;and
WHEREAS, the West Memphis Utility Commission has approved the acquisition of
Entergy's electrical distribution line;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. Competitive bidding be waived for the following item to be used by the
City, described as follows:
An electrical distribution line owned by Entergy consisting of 13.2KV facilities on County
Road #7 in the amount of $20,350.00
SECTION 2. All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
