ORDINANCE NO.
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE
OF COMPUTERS AND T.Q. UPGRADE COMPUTER SOFTWARE FOR THE
CITY OF WEST MEMPHIS,ARKANSAS, DECLARING AN EMERGENCY,
AND FOR OTHER PURPOSES
WHEREAS,Arkansas Code Annotated §14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and ,
WHEREAS,there are many items necessary for the City's use:where competitive'.
bidding is deemed not feasible or practical; and
WHEREAS, the City of West Memphis is in need of purchasing forty-one (41)new
computers,and upgrading computer software to be purchased through the JAG grant for the West
Memphis Police Department; and
WHEREAS, C &T Solutions provides technical.support for the City's computers and
has computers and the software upgrades that are needed and are compatible with the"City's
computer system; and..
WHEREAS, upgrades of computers to include Windows 10 is necessary and there is a
deadline in place for the installation of Windows :10;
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS,ARKANSAS:
1.. That competitive bidding be waived for the following item to be used by the City,
described as follows:
The purchase and installation of forty-one (41) computers and software upgrades to be
. provided by C &T Solutions in the amount of thirty-five thousand one hundred dollars
4 . ($35,100.00),to be paid from the JAG Grant for the West.Memphis Police Department.
2. . EMERGENCY CLAUSE. It having been found and determined by the City
Council of the City of West Memphis, Arkansas,that new computers and software upgrades are
in need to keep the City of West Memphis computers up to date and functioning properly and
that there is an urgent and immediate need due to limited time being available to keep the City
computers functioning properly and to allow the City to conduct business on a regular day to day
basis, an emergency is hereby declared to exist, and this Ordinance being necessary for the
preservation of the public peace,health, safety and welfare of the Citizens of West Memphis,
Arkansas, shall be in full force and effect from and after the date of its passage and approval.
