RESOLUTION NO. ISM 6
A RESOLUTION CONCERNING ENVIRONMENTAL PROTECTION AGENCY
AIR QUALITY STANDARDS.
WHEREAS, the EPA has reviewed air pollutants and determined that current standards
for ozone and particulate matter are inadequate; and
WHEREAS, the City of West Memphis and Crittenden County, Arkansas are currently
classified as an attainment area; and
WHEREAS, due to the proximity of West Memphis and Shelby County, in a letter dated
March 14, 1991, from then Arkansas Governor Bill Clinton to EPA stating that:
It is obvious from the data presented in the inventory, that the bulk of ozone producing
pollutants is emitted in Shelby County, Tennessee. This is due to the fact that Shelby
County has the largest population, traffic network, and commercial/industrial development
in the Tennessee-Arkansas-Mississippi area.
In Arkansas, the total point, area and mobile emission of VOC's is reported as less that
6,800 tons per year (TPY). One point source in Shelby County, the Tennessee Valley
Authority [which is down stream to the prevailing wind currents in this area], is shown to
emit more than 13,000 TPY. Another Shelby County Point source emits as much as 5,900
TPY.
and;
WHEREAS, we feel there has been no significant change in this situation and balance
from 1991 until the present; and
WHEREAS, the economic demands of complying with more stringent regulations would
place and unfair and undue burden on the population of Crittenden County in comparison to the
entire Memphis Urbanized Area; and
WHEREAS, the current EPA standards have proven to be adequate int he areas of health
and economic loss and benefit ratios and do not currently warrant a change;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, that the City of West Memphis, Arkansas affirms
that the current EPA air quality standards remain in place for this area.
