A RESOLUTION TO ENCOURAGE THE CITY OF MARION TO JOIN
WITH THE CITY OF WEST MEMPHIS TO RESOLVE LITIGATION BY
REFRAINING FROM EFFORTS TO ANNEX CERTAIN DISPUTED
PROPERTY EXCEPT BY VOLUNTARY PETITION OF THE PROPERTY
OWNERS.
WHEREAS, the City of West Memphis and the City of
Marion have each attempted annexations by elections held on
August. 30, 1990, by which the City of Marion has attempted
to annex an area included within the area which the City of
West Memphis has attempted. to annex; and
WHEREAS, these attempted annexations have resulted in
litigation between the City of West Memphis and the City- of
Marion; and
WHEREAS,:an.agreeable negotiated resolution of such
litigation is preferable to prolonged litigation which
could result in great expense to each city and deter
possible development of the disputed area; and
WHEREAS, the City of West Memphis believes that it
would be mutually beneficial to the City of Nfarion and to
the City of West Memphis to seek a prompt and agreeable
resolution of this matter; and
WHEREAS, the City of West Alemphis believes that under
the present circumstances the property owners in the
disputed area should be given the opportunity to
voluntarily petition the city of their choice for
annexation;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, that the City of Marion

is hereby encouraged to join with the City of West Memphis
to explore the possibility of resolving the issues raised
by these attempted annexations in such a manner that would
have each city agree to refrain from efforts to annex, by
any means other than by voluntary petition of one or more
property owners, any portion of the disputed area for a
period of twelve or eighteen months.
