A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST MEMPHIS, ARKANSAS RECOMMENDING OPPOSITION
TO THE RECENT FILING OF SENATE BILL 320 IN THE
ARKANSAS SENATE; RESPECTFULLY REQUESTING THE
WEST MEMPHIS LEGISLATIVE DELEGATION TO OPPOSE
SENATE BILL 320; AND FOR OTHER PURPOSES
WHEREAS, there was filed on February 4, 1991 in the Arkansas
Senate, Senate Bill 320, "An Act To Extend The Provisions of
Arkansas Code Annotated 23-18-101 To Municipally Owned or Operat-
ed Electric Public Utilities" And For Other Purposes; and,
WHEREAS, Senate Bill 320 is an attempt by the rural electric
cooperative corporations to stymie competition in "green belt"
areas adjacent to municipalities where competition exists amongst
electric utilities for new industrial loads; and
WHEREAS, Senate Bill 320 may vest with the Arkansas Public
Service Commission jurisdiction over rates charged by the West
Memphis Utility Commission to certain customers within the West
Memphis City limits, and thus oust both the electorate of West
Memphis and the West Memphis City Council from that rate-making
jurisdiction. Also, Senate Bill 320 may forever limit the West
Memphis Utility Commission's service territory to current bound-
arees;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
SECTION I. The West Memphis legislative delegation is
respectfully requested to strongly oppose Senate Bill 320 as it
may, in part, oust the electorate of the City of West Memphis and
the West Memphis City Council from the right to set rates for
certain of the city's electric customers located inside the city
limits and supplied by the West Memphis Utility Commission, and
further stymie competition for new industrial load in areas
adjacent to the City of West Memphis or otherwise forever limit
the service area of the West Memphis Utility Commission to cur-
rent limits.
SECTION 2. This Resolution shall be in full force and
effect from and after its passage and approval.
