A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST MEMPHIS, ARKANSAS RECOMMENDING OPPOSITION
TO THE RECENT FILING OF SENATE BILL 320 IN THE
ARKANSAS SENATE; RESPECTFULLY REQUESTING THE
GOVERNOR OF THE STATE OF ARKANSAS TO OPPOSE
SENATE BILL 320; AND FOR OTHER PURPOSES
WHEREAS, there was filed. on February 4, 1991 in the
Arkansas Senate, Senate Bill 32U, "_4n act To Extend The
Provisions of Arkansas Code .Annotated 2:i-18-1U1 `To
Municipally Owned. or Operated E.Lectric P~iblic Utilities"
And For Other Purposes; and,
WHEREAS, Serrate Bill 330 is an attempt by the rural
electric cooperative corpor<ltions to stymie competition in
"green belt" areas adjacent t,o mi_rnicipalities where,
competition exists amongst electric utilities for new
industrial loads; and
WHEREAS, Senate Bill 32U may- vest with the Arkansas
Public. Service Commission jurisdiction over rates charged
by the West Memphis Utility Commission to certain customers
within the West Memphis City limits, and thus oust both the
electorate of West Memphis and the West Memphis City
Council from that; rate-making .jurisdiction. Also, Senate
Bill. 320 may for_e__v_er limit the West. rlemphis Utility
Commission's service territory to cur~rent boundaries;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
SECTION I. The Honorable (3overnor• of the State of
Arkansas, Bill Clinton, is respect,fi~lly requested to
veto Senate Bill 320 as it may, in part., oust the
electorate of the City of West Memphis and the West Memphis
City Council from the right to set rates for certain of the
City's electric customers located inside the city limits
and supplied by the West Memphis Utility Commission, and
further stymie competition for new industrial load in areas
adjacent to the City of West Memphis or otherwise forever
limit the service area of the West Memphis Utility
Commission to current limits.
SECTION 2. This Resolution shall be in full force and
effect from and after its passage and approval.
