A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS AUTHORIZING AND
DIRECTING THE EXECUTION OF SECOND AMENDMENT
TO AGREEMENT FOR ELECTRIC PEAKING POWER
SERVICE BETWEEN ARKANSAS POWER AND LIGHT
COMPANY AND THE CITY OF WEST MEMPHIS,
ARKANSAS; AND FOR OTHER PURPOSES
WHEREAS, by withdrawing from certain litigation at
the Federal Energy Regulatory Commission, the City of
West Memphis, Arkansas (West Memphis) has been offered
a Second Amendment to Peak Power Agreement by Arkansas
Power and Light Company (AP&L); and,
WHEREAS, West Memphis is desirous of amending the
First Amendment to Agreement for Electric Peaking Power
Service between AP&L and West Memphis dated December
18, 1986; and,
WHEREAS, such Second Amendment to Peaking Power
Agreement will extend the term of Agreement for Peaking
Power Service, and provide more favorable terms for
electric service by fixing peak power charges and
methods of charge therof.
NOW, THEREFORE BE IT RESOLVED, by the City Council
of West Memphis:
Section 1. The Manor, or i.z~i his absence, the Vice-
Manor, and the Cite C_lerl~ are hereby directed to execute
said Second Amendment. to Peaking Power Agreement by and
between AP&L and West Memphis in a form substantiallS~
similar to that presented and attached hereto.
5ection_2._ `T'his Resolution shall be in full force
and effect from and after i.ts passage and approval.
