RESOLUTION NO. ia5a
A RESOLUTION AUTHORIZING THE WEST MEMPHIS AIRPORT
COMMISSION TO CONDEMN A CLEAR ZONE EASEMENT.
WHEREAS, the West Memphis Airport Commission has
attempted to negotiate the acquisition of a clear zone
easement above the property identified as Parcel No. 5 on
the map attached hereto as Exhibit A; and
WHEREAS, efforts to negotiate the acquisition of the
clear zone easement above said property have been
unsuccessful; and
WHEREAS, the acquisition of a clear zone easement above
said property is necessary for the future growth and
development of West Memphis Municipal Airport; and
WHEREAS, the West Memphis Airport Commission has
determined that it will be necessary to condemn a clear
zone easement above said property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, THAT the West Memphis
Municipal Airport Commission and its legal counsel are
hereby authorized to bring a condemnation action for the
purpose of condemning a clear zone easement above the
property set out in the attached Exhibit A and designated
Parcel 5.
