Mayor McClendon announced that due to the assistance of Southland Gaming&Racing and the West Memphis Community Block Grant,he is happy to announce that the City of West Memphis will be having the Summer Youth Program again this year. It will be a 5-week program and they will be employing 35 to 40 young people to work in different departments within the city's municipality. Mayor McClendon said that he is happy to announce that the Rich Road project is 60% completion. Mayor McClendon said it should not take much longer to get to the 90% completion. Senator Murdock and Lorie Tutor, and Halff Engineers have all been essential in helping them to put pressure on ARDOT to give them answers and he thanked them for all their help.He could not give council a date as to when the project would begin, but is hopeful that it won't be much longer.Councilor Croom asked about an update on the Redding Street Bridge and Councilor Mondy asked about the 7th Street Bridge. The mayor said he would follow up and give them an update on the status of the bridges to see what could be done. Mayor McClendon said that he received good and bad reactions to the basketball goals being removed at Grove Park on North 11th Street.Mrs.Robinson sent him a thank you letter, however he did have some negative feedback from a group of people from Gino Church who live on the street by the park,they-were upset because they were not informed that the goals were going to be removed and they were not happy about it.The mayor said that they needed to follow up with their council members who represent that ward and let them know how they feel. Councilor Bruce and Councilor Hutchinson were not in attendance at the May 18,2023, council meeting to speak on the citizens concerns with the goals being removed. Councilor Mohammed asked if the moratorium was temporary. Councilor Catt said the moratorium was established for 90 days and after 90 days they will be looking to see if things did or did not improve as a result of them taking down the goals and make a decision at that time on how to move forward.Mayor McClendon said the people felt that the children and many of the great athletes that have come out of West Memphis developed their skills from playing basketball in their local parks. Councilor Mohammed suggested that they might want to look into finding a big field to build a major basketball court for people to play basketball that will not impact the residents. The mayor said that might be something to consider. Councilor Mondy asked about the plans to restore the tennis courts at Tilden Rogers Park.Mayor McClendon said that in the next couple of weeks he and the Parks Director,Lorenzo Parker and Ladd Gary Architects will be getting with council to present the plans for Tilden Rogers Park to get councils approval. Mayor McClendon said it is a goal this year to get all three parks completed as well as plans for an all-inclusion park. He said he wanted to commend Community Development Coordinator,. Raymond Whiteside for his work on securing grants to enable West Memphis to be a city to have an all-inclusion park designed for children with special needs, autism, intellectual disabilities, vision impaired, sensory, mental, and physical disabilities. He said that he is excited at the prospect of being able to offer a park that meets the needs of people with disabilities. The mayor wanted to bring it to everyone's attention that it is summertime and with that grass is growing and he is encouraging everyone that owns properties to cut their own properties. He said that it is not the responsibility of the City of West Memphis to cut their property. He said if property owners do not live here they need to have someone to maintain their properties, especially the vacant lots. Mayor McClendon said the council created the grass cutting department and they are doing a good job,but they can not cut the lots every two weeks, going forward they will be cutting them and then they are going to spray them to kill the grass and if need be he will come back before council to ask for an increase in the amount that they charge for the city and grass contractors having to cut peoples properties that do not maintain their own properties and it will be substantial, some cities such as Littlerock are charging up to $350.00 per cut,but if that is what it takes to make people be responsible for maintaining their own properties he will bring it back before council for their approval as well as it will be an awakening for negligent property owners. The city crews are being overworked with having to not only cut city properties but private properties. The mayor is also asking everyone that owns properties to be responsible for their own properties to help with improving how West Memphis looks.Mayor McClendon said they are in the process of cutting the Bayou's and spraying them and if they have not gotten to a certain area, they will get to it soon. Councilor Harris expressed concerns with individuals that are only cutting the center of their properties, but they are not cutting the outer area and they are severely overgrown properties along 25th Street and Autumn and on 16th Street in the 600 block. Councilor Croom asked if they could get any help from the churches to help people in their areas that might not be able to afford to cut their yards. The mayor said he did not know but that he would appreciate any help that he could get.Councilor Holt said what he is finding in his area with overgrown grass is with abandoned houses. Mayor McClendon announced that MATA is getting ready to start their preliminary runs in July.He is asking everyone to continue to promote the city because we have great things happening throughout the city. Southern Bank Corps had their grand opening earlier in the day and they will not only be offering checking and saving services, but they will be offering assistance with matching down payments to purchase a home and credit repair. The city will also be getting a major retail development coming to West Memphis and they are in conversations with a developer to build homes, and it looks very promising. Councilor Catt made a motion, seconded by Councilor Croom to reschedule the June 15,2023, council meeting to June 22,2023,at 5:00 p.m.Upon voice vote, voting was unanimous to approve. The mayor and council will be attending the Arkansas Municipal League in Little Rock from June 14-16. Councilor Harris asked that everyone be in prayer for Councilor Hutchinson's mother who has been ill. CITIZENS REQUEST: Ms.Angela Lamar was not present at the council meeting to present her plans to council for her two properties that need to be brought up to code to have councils' consideration for removing the homes off the demolition list as she agreed upon at the last council meeting.Mayor McClendon deferred to Councilor Mohammed and Councilor Murray who are the council members for the ward where the properties are located. Councilor Mohammed said that she spoke with them after the last council meeting and they were to have met with Planning Supervisor,Marilyn Phelix to discuss their plans.Ms. Phelix said that they did meet with her, and they were advised to present weekly progress reports to her and provide pictures showing what they had done as well as she suggested that they start with the exterior of the home to buy them some time and then move onto the interior. They were supposed to bring in the pictures to her today or no later than Friday, but they were unable to do so because Ms. Lamar's fiancé was at the hospital.Mayor McClendon asked if other than Ms.Lamar's properties that were in question, did they want to move forward with the demolition of the other homes that were on the list. Councilor Mohammed deferred to the city attorney. City Attorney Stepheson said if the properties had been determined to be dilapidated the city could demo them, the property owners would still own the properties the city would just attach a lien against the property to recoup the money that it cost to demolish the structure.Mayor McClendon also addressed the young lady wanting to bring substandard mobile trailers into West Memphis and asked why she was not taking them to an area in Mississippi where she lives. The response is because Mississippi does not allow them. The mayor said that he is trying to improve that area and two of the three trailers that were brought in have already been condemned and the last one that was brought in is in the same condition,he has given her 30 days to remove the trailer. A young man has spoken with the mayor, and he is excited about the change and would like to see the activity and behaviors affiliated with these types of dwellings eliminated. The mayor said that the only people that will be allowed to be in mobile homes in that area are the ones that already live there,he deferred to the city attorney for direction.City Attorney Stephenson said it is like any other structure if it is not habitable and it is determined that it is unsafe to inhabit you would be looking at condemning it.Councilor Catt is in the process of taking a class on manufactured homes and as soon as he completes the class he will get all that information to Ms. Phelix Sr. Deputy City Clerk,Patricia reminded council members about the Municipal League dates and the importance of attending classes and ensuring that they have their badges scanned at the completion of each class to ensure that that they receive their credits toward certification. Having no further business to come before the City Council,Councilor Murray made the motion, seconded by Councilor Mondy,to adjourn.Upon voice vote, the voting was unanimous. The meeting was adjourned at 1:45 p.m. PASSED and APPROVED this 22nd DAY OF JUNE 2023. F. Intentionally causing a collision with another motor vehicle for the purpose of functionally damaging or forcing the other vehicle off the road. G. Intentional discharge of a firearm. V. De-escalation of Force De-escalation tactics and techniques are those actions undertaken by an officer(s) to avoid physical confrontations, unless immediately necessary to protect someone or to stop dangerous behavior, while minimizing the need to use force during an incident when the totality of the circumstances and time permit. De-escalation tactics and techniques are employed to increase the likelihood of voluntary compliance and cooperation. 1. When time and circumstances reasonably permit, an officer(s) shall consider whether a subject's lack of compliance is a deliberate attempt to resist or is the result of an inability to comply based on factors including, but not limited to: • Medical conditions • Mental impairment • Developmental disability • Language barrier • Drug interaction • Behavioral crisis • 2. An officer's awareness of these possibilities, when time and circumstances reasonably permit, shall then be balanced against the facts of the incident and which tactical options are the most appropriate to bring the situation to a safe resolution. An officer is not expected to engage in force de-escalation measures that could jeopardize the safety of the community or of any employee. 3. Officers need only select a level of force that is within the range of"objectively reasonable"options. Officers must rely on training, experience, and an assessment of the situation to decide an appropriate level of force to be applied. Reasonable and sound judgement will dictate the force option to be employed. Use of Force Page 3 of 7 bie no d fi RECEIVED 7 `moo ,ten WEST MEMPHIS POLICE DEPARTMENT POLICY AND PROCEDURES 4. Officers may use such force as is reasonably necessary under the circumstance to carry out their official duties. B. Once the subject's active resistance has ceased and control has been gained, an officer is no longer authorized to use force. C. Officers have an affirmative duty to intervene if they witness force used by another officer that is clearly unreasonable. (See Putnam v. Gerloff 679 F2nd 415 8th Cir. 1981) 1. When in a position of safety to do so, any officer that observes another officer use force that is clearly unreasonable under the circumstances shall intervene to prevent continued unreasonable force. 2. Any officer who observes another employee use unreasonable force should promptly report such observations to a supervisor. VII. Actions by an officer which are not considered use of force include, but are not limited: A. ThP reasonable touching of a person or a firm grasp utilized to maintain control, guide, or assist an individual. B. The application of handcuffs where the person being handcuffed does not offer serious physical resistance. C. The reasonable touching or display of an authorized weapon. VIII. Use of Non-Deadly An officer is authorized to use non-deadly physical force or threaten to use deadly physical force upon another person if the officer reasonably believes it necessary to: A. Effect an arrest or to prevent the escape from custody of an arrested person unless the officer knows the arrest is unlawful; or Use of Force Page 4 of 7 WEST MEMPHIS POLICE DEPARTMENT POLICY AND PROCEDURES B. Defend himself or herself or a third person from what the officer reasonably believes to be the use or imminent use of physical force while effecting or attempting to effect an arrest or while preventing or attempting to prevent an escape. (See A.C.A. § 5-2-610 (a) (1-2).) IX. Use of Deadly Force A. Use of deadly physical force is reviewed by an Arkansas prosecutor under Arkansas criminal law to determine if criminal charges will be filed against an officer. Specifically, A.C.A. § 5-2-610(b)(1) - (2) states as follows: An officer is authorized in using deadly physical force upon another person if the officer reasonably believes that it is necessary to: (1) effect an arrest or prevent the escape from custody of an arrested person whom the officer reasonably believes has committed or attempted to commit a felony and is presently armed or dangerous; or (2) defend himself or herself or a third person from what the officer reasonably believes to be the use or imminent use of deadly physical force. X. Appropriate Medical Assistance (Render Aid) Officers should immediately provide appropriate medical assistance to the subject of the use of force to the degree to which they are trained and/or request emergency medical services to respond when necessary. Appropriate medical assistance will be provided in a safe and reasonable manner to any person who is injured or who complains of injury and includes but is not limited to: A. As soon as reasonable, placing a person in an appropriate recovery position to aid in breathing and to reduce the chances of positional asphyxiation. B.
