WHEREAS, William G. Abernathy has filed with the West Memphis
City Clerk a Petition to vacate an alley located in the City of
West Memphis pursuant to ACA § 14-301-301, et seq; and,
WHEREAS, said statutes require that the City Council, by
resolution, fix a day for the hearing of the Petition and direct
the giving of notice of the hearing by publication as directed
therein;
BE IT RESOLVED, that the hearing on the Petition of William
G. Abernathy should be set for the 6th day of February , 1992, at
1:30 p.m., and the Petitioner shall publish notice of said
hearing pursuant to said statutes.

PETITION TO VACATE ALLEY
Comes the Petitioner, William G. Abernathy, by and through his
attorneys, and states that his is the sole owner of all property
abutting upon the following described alley in West Memphis,
Arkansas, to-wit:
The alley ten feet in width running East and West
reflected on the plat entitled Subdivision of Lot 1,
Horsley's Addition, Town of West Memphis, Arkansas,
prepared by C. H. Bond of Marion, Arkansas, on July 24,
1928, and recorded in Plat Book 1 at page 34 in the
office of the Circuit Court Clerk and Ex-Officio Recorder
for Crittenden County, Arkansas. A copy of said plat is
attached hereto, marked Exhibit "A", and incorporated
herein by reference.
Petitioner is seeking to vacate the above described alley.
That said right of way has not been used as a street or alley for
a period greatly in excess of five (5) years. That upon the
abandonment of this alley, title to said right of way shall vest
in the Petitioner.
WHEREFORE PETITIONER PRAYS that the City Council of the City
of West Memphis, Arkansas, at its next regular or special meeting
fix a day for the hearing of the Petition and direct the City Clerk
to give notice of such hearing as required by law; that following
said hearing the above described alley be vacated and all rights
of the City of West Memphis and of the public therein generally be
released, vacated and abandoned.
