AN ORDINANCE TO AMEND ARTICLE 5-USES AND USE CONDITIONS,
TABLE 5.1-TABLE OF USES, ARTICLE 5-USES AND CONDITIONS, SECTION
5.2-USE CONDITIONS-UCT TABLE 14,MANUFACTURED HOME
SUBDIVISIONS, AND THE AREA SOUTH OF WONDER JUNIOR HIGH OF
THE ZONING REGULATIONS AND OFFICIAL ZONING MAP ADOPTED BY
ORDINANCE NO. 2591 FOR THE CITY OF WEST MEMPHIS,ARKANSAS,
AND FOR OTHER PURPOSES.
WHEREAS, the Planning Commission of the City of West Memphis, Arkansas, has
prepared amendments to Ordinance 2591, which adopted zoning regulations and an official
zoning map for the City of West Memphis, Arkansas; and
WHEREAS, pursuant to Article 7, Section 7.1 a and Section 7.1 b of the zoning
regulations adopted by Ordinance 2591, the Planning Commission has approved and
recommended for adoption the proposed amendments of the zoning regulations and the official
zoning map for the City of West Memphis,Arkansas;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS,ARKANSAS:
SECTION 1. Article 5 — Uses and Use Conditions, Table 5.1: Table of Uses of the
zoning regulations adopted by ordinance 2591 is hereby amended, to read as follows:
B. RESIDENTIAL USE CATEGORY
20. Manufactured(mobile) homes: Single-family, scattered site manufactured
(mobile) homes are permitted in CV-Conservation zoning only and are removed
from Mixed Residential Medium and Mixed Residential High zoning. (See
attached amended Table of Uses).
21. Modular Homes:, Modular Homes are permitted in CV-Conservation zoning by
right, and.in MRM-Mixed Residential Medium and MRH-Mixed Residential
High zoning by special use permit only. Modular homes can also be in
manufactured home subdivisions. (See attached amended Table of Uses).
22. Manufactured Home Subdivision/Parks: Manufactured(mobile) homes are
permitted in existing manufactured home parks and manufactured home
subdivisions within West Memphis' existing zoning classifications.New
manufactured home parks, subdivisions, and scattered-site manufactured homes
are peiiuitted in CV-Conservation zoning with special use permits only. (See
attached amended Table of Uses).
SECTION 2. Article 5 —Uses and Use Conditions, Section 5.2: Use Conditions, UCT
Table 14 of the zoning regulations, adopted by Ordinance 2591, is hereby amended, to read as
follows:
UCT TABLE 14. Manufactured Home Subdivisions
General Requirements
a) All manufactured homes so located within an approved subdivision must have the
date plate attached to the unit specifying"This mobile home is designed to
comply with Federal Mobile Home Construction Safety Standards in force at the
time of Manufacture".
b) Manufactured home subdivisions shall fully comply with the regulations of this
Ordinance and further be governed by the Land Subdivision and Development
Code of the City of West Memphis.
c) Individual Manufactured homes located within a manufactured home subdivision
shall comply with the conditions of UCT Table 14. Manufactured Homes
d) Manufactured homes built prior to 1976 are not permitted in any zoning
classification within the City of West Memphis. All manufactured homes
delivered within the City of West Memphis authority after May 18, 2023, must
obtain a permit to be inspected for site preparation/grading, foundation
construction, and/or anchorage. The manufactured home must also comply with
the HUD Manufactured Home Construction and Safety Standards, 3rd Set Final
Rule (Effective, July 12, 2021) and must have a HUD Certification Tag stating,
"This mobile home is designed to comply with Federal Mobile Home
Construction Safety Standards in for a the time of manufacture.
SECTION 3. That the West Memphis Zoning Map and Zoning Regulations adopted by
Ordinance No. 2591, is hereby amended as follows:
Zoning Map (See attachment).
'Amend zoning area south of Wonder Junior High from MRH-Mixed Residential
High to MRM-Mixed Residential Medium.
SECTION 4. All ordinances or parts of ordinances in conflict herewith are hereby

repealed. '
