2617 Ordinance No. 7-67 I I AN ORDINANCE TO ESTABLISH FEES FOR PERMITS AND INSPECTIONS AT RESIDENTIAL RATES AND COMMERCIAL AND INDUSTRIAL RATES WITHIN THE CITY LIMITS OF WEST MEMPHIS, ARKANSAS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS, ARKANSAS: SECTION 1. ORDINANCE REPEAL: That Ordinance No. 760, Article IV, Section 2, passed and approved, February 1, 1973; and Ordinance No. 797, passed and approved, February 21, 1974; and Ordinance No. 801, passed and approved, March 21, 1974; and Ordinance No. 959, passed and approved, April 5, 1979; and Ordinance No. 2586, passed and approved October 7, 2021, be void and repealed. SECTION 2. DISTINCTION OF PERMIT FEES: Distinction of Residential, Commercial, and Industrial permits, plumbing, building sewer, water service line, and gas permits shall be distinguished Residential at one rate: and, Commercial and Industrial at another rate. The determination of whether Residential, Commercial, or Industrial shall me made according to the present zoning of the City of West Memphis, that the structure being permitted is located. This location shall be determined by the administrative authority in the plumbing division. One (1) and two (2) family housing units on one (1) lot shall be classified residential; and, any more family housing units in a structure on one (1) lot (i.e. apartment complex) shall be classified commercial. SECTION 3. PERMITS: Permit fees are determined as provided in Attachment"A". SECTION 4. REQUIRED: In accordance with Ordinance No. 2341 any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by this Code, or to cause any such work to be done, shall first make application to the building official and obtain the required permit. A permit shall not be valid until the fees prescribed by law have been paid, nor shall an amendment to a permit be released until additional fees, if any, have been paid. Each permit shall be paid in accordance with the schedule established by the applicable governing body. SECTION 5. PENALTIES FOR VIOLATIONS: Any person violating any of the provisions of this ordinance or any rule or regulation established and prescribed under Sections 105 or 109.1 of the Arkansas Fire Prevention Code (2012) shall be subject to fines in accordance with the City of West Memphis Code of Ordinances Part 1 Section 1-7. SECTION 6. VALIDITY CLAUSE: If any section, sub-section, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional or otherwise invalid, such - CEIVED unconstitutionality or invalidity shall not affect the remainder of this Ordinance and all ordinances or parts of ordinances in conflict herewith are hereby repealed PASSED AND APPROVED this day of rEktikel , 2023. aVL MARCO M. (B)Remodeling of Existing Structures A fee of$1.25 per one thousand dollars of value with a minimum charge of $45.00 will be charged for each permit issued for remodeling of structures. (C) Roofing Repairs and/or Replacement A fee of$1.25 per one thousand dollars of value with a minimum charge of $45.00 will be charged for each permit issued for roofing. (D) Industrial New Construction Sqft. Total Cost: Base Fee is$15.00 for the first 300sgft: $00.05 for each sqft up to 50,000sqft: $00.04 for each sqft up to 500,000sqft: $00.005 for each sqft above 500,000sqft: Arkansas Construction Education Program Permit Fee $.50 per$1,000 Value of Construction Tax.
