2655 ORDINANCE NO. 255
AN ORDINACE WAIVING COMPETITIVE BIDDING FOR THE REPAIR OF
FLOOD POND PUMP#2 MOTOR,DECLARING AN EMERGENCY AND FOR
OTHER PURPOSES.
WHEREAS,Arkansas Code Annotated Section 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS,there are many items necessary for the City's use where competitive bidding
is deemed not feasible or practical; and
WHEREAS,the flood pump station was designed to provide the maximum benefit with
six(6)pumps; and
WHEREAS,Pump#2's 400 HP motor has failed; and
WHEREAS,a motor contractor, Integrated Power Services(IPS),is already repairing
pump#1 and Pump#3's motors; and
WHEREAS,IPS is already familiar with the operation of the Flood Pond motors; and
WHEREAS,it would be time consuming to develop bid document and bid the work and
IPS can start the work now and have the motor repaired and allow the flood pumping station to
be at it maximum pumping capacity before the spring rainy season; and
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS,ARKANSAS;
SECTION 1: That competitive bidding be waived for the repair of Flood Pond Pump#2's
motor by Integrated Power Services for a cost of$75,565.62.
SECTION 2: EMERGENCY CLAUSE. It having been found and determined by the
City Council of the City of West Memphis,Arkansas,that there is an urgent need to repair the
motor for Flood Pond Pump#2 to maximize the full pumping capacity to prevent flooding in the
city, an emergency is hereby declared to exist, and this Ordinance being necessary for the
preservation f the public peace,health, safety and welfare of the citizens of West Memphis,
Arkansas, shill be in full force and effect from and after the date of its passage and approval.
