2656 ORDINANCE NO. 2 4 q ' AN ORDINACE WAIVING COMPETITIVE BIDDING FOR THE REPAIR OF PUMP#1 (100 HP)AND PUMP#2 (400 HP)FOR THE FLOOD PUMP STATION, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. WHEREAS,Arkansas Code Annotated Section 14-58-303 allows waiving of competitive bidding in exceptional situations where such procedure is deemed not feasible or practical; and WHEREAS,there are many items necessary for the City's use where competitive bidding is deemed not feasible or practical; and WHEREAS,the flood pump station was designed to provide the maximum benefit with six(6)pumps; and WHEREAS,Pump#1, a 100 HP pump and Pump#2, a 400 HP pump,have failed; and WHEREAS,in August 2022 Pump#3,a 1,000 HP pump,was pulled and sent to the manufacturer's factory in Kansas City for repairs and has yet to be returned and put back into service; and WHEREAS,the same manufacturer no longer services the smaller 100 HP and 400 HP pumps; and WHEREAS,before the pumps could be examined and the amount of repair work determined,they had to be removed from the pump station and sent to a factory; and WHEREAS,it would not be practical to invite bidders to pull the pumps,take them to their factory,develop an estimate and then return the pumps for another bidder to pick up,take to their factory,develop an estimate,return the pumps and submit a bid;and WHEREAS,a local consultant who has long worked with the West Memphis Utilities and is a consultant for the Army Corps of Engineer's Huxtable Pumping Station was able to recommend a reliable pump repair and maintenance firm,National Water Services; and WHEREAS,National Water Services pulled the pumps, inspected them and provided a quote to repair the 100 HP pump for$60,150.00 and the 400 HP pump for$84,076.08 and to have both pumps back in service 8 to 10 weeks after receipt of a purchase order; and WHEREAS,it is desirous to have the flood pump station capable of pumping at its full capacity before the spring rainy season; NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS,ARKANSAS: SECTION 1: That competitive bidding be waived for the repair and installation of Pump #1, a 100 HP pump and Pump#2, a 400 HP pump for the flood pump station by National Water Services for the total cost of$144,226.08. SECTION 2: EMERGENCY CLAUSE. It having been found and determined by the City Council of the City of West Memphis,Arkansas,that there is an urgent need to repair Pump #1 and Pump#2 of the Flood Pump Station to maximize the full pumping capacity to prevent flooding in the city, an emergency is hereby declared to exist,and this Ordinance being necessary for the preservation of the public peace, health, safety and welfare of the citizens of West Memphis,Arkansas, shall be in full force and effect from and after the date of its passage and approval.
