2657 ORDINANCE NO. 2-4 5 7
AN ORDINACE WAIVING COMPETITIVE BIDDING FOR THE BORING OF
CONDUIT TO SERVICE A TRANSFORMER AT SOUTHLAND CASINO,
DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS,Arkansas Code Annotated Section 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS,there are many items necessary for the City's use where competitive bidding
is deemed not feasible or practical; and
WHEREAS, Southland Casino has recently undergone extensive expansions which has
dramatically increased its electrical needs; and
WHEREAS,during the summer of 2023, additional electrical supply was needed, due to
the hot weather,on an emergency basis; and
WHEREAS,the West Memphis Utilities provided Southland Casino a third transformer;
and
WHEREAS,additional electrical service was required for the third transformer; and
WHEREAS,the additional electrical service was available from overhead lines along
Southland Drive; and
WHEREAS,from that point to the transformer location, electric service needed to be
underground; and
WHEREAS,the additional line was needed to ensure Southland Casino would have a
reliable supply of electricity to maintain its business; and
WHEREAS,there was not time to bid the work out and a reliable, experienced company,
Lesley Contractors,that was known to the West Memphis Utilities was available to do the work
immediately; and
WHEREAS,the West Memphis Utilities engaged Lesley Contractors to bore and install
two 4"Sch 80 conduits 1,215 feet to provide a pathway for the electric feeds at a cost of
$72,900; and
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS,ARKANSAS:
SECTION 1: That competitive bidding be waived for the underground bore of 1,215 feet
for the installation of two conduits by Lesley Contractors for a total cost of$72,900.00.
SECTION 2: EMERGENCY CLAUSE. It having been found and determined by the
City Council of the City of West Memphis,Arkansas,that there is an urgent need to bore and
install two 4" Sch 80 conduits 1,215 feet to provide a pathway for the electrical feeds to ensure a
reliable supply of electricity to Southland Casino, an emergency is hereby declared to exist,and
this Ordinance being necessary for the preservation of the public peace,health, safety and
welfare of the citizens of West Memphis,Arkansas, shall be in full force and effect from and
after the date of its passage and approval.
