RESOLUTION NO. ~.'t$I
A RESOLUTION APPROVING THE SELECTION OF KENT J. RUBENS
TO PROVIDE LEGAL SERVICES ON BEHALF OF THE WEST MEMPHIS
CITY COUNCIL AND THE WEST MEMPHIS UTILITY COMMISSION.
WHEREAS, Arkansas Code Annotated Section 19-11-801, et
seq., provides the procedure for the selection and
negotiation of contracts for professional services,
including legal services; and
WHEREAS, competitive bidding for the procurement of
legal services is prohibited; and
WHEREAS, the City of West Memphis is in need of
contracting for legal services on behalf of the West
Memphis City Council, its members, the West Memphis Utility
Commission, and its Commissioners, for legal representation
and defense in the matter of Barbara Jones vs. West Memphis
Utility Commission, et al., filed as case number LRC-92-123
in the U.S. District Court for the Eastern District of
Arkansas; and
WHEREAS, the City of West Memphis has reviewed and
evaluated the current annual statements of qualifications
and performance data on file, selected the required number
of firms and negotiated with the firm considered the best
qualified and capable of performing the desired work, that
being Kent J. Rubens;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, that the selection of
Kent J. Rubens to provide legal services to the West
Memphis City Council, its members, the West Memphis Utility
Commission, and its Commissioners for representation and
defense in the matter of Barbara Jones vs. West Memphis
Utility Commission, et al., is hereby approved and the
Mayor and the Clerk are hereby authorized to execute the
necessary contracts on behalf of the City of West Memphis
for such professional legal services.
