BID OPENING: None
MINUTES:APPROVE OR CORRECT MINUTES OF MARCH 21,2024
Councilor Catt made the motion, seconded by Councilor Croom,to dispense with the reading
of the March 21, 2024, Council Minutes and to approve them as submitted. Upon voice vote,
voting was unanimous to approve.
OLD BUSINESS:
3rd READING OF AN ORDINANCE TO ESTABLISH FEES FOR PERMITS AND INSPECTIONS AT RESIDENTIAL
RATES AND COMMERCIAL AND INDUSTRIAL RATES WITHIN THE CITY LIMITS OF WEST MEMPHIS,
ARKANSAS
City Attorney Stephenson read the ordinance by title only for the THIRD and FINAL time. Councilor Catt
made the motion, seconded by Councilor Croom to approve. Discussion followed. Councilor Mohammed
asked had there been any opposition to the ordinance. Planning& Development Director, Chad Bowman
said that he was not aware of any opposition, but suggested that council hold off on voting on the
ordinance to allow the department time to hold another public meeting to allow the public to speak on
the change for the fee for a certificate of occupancy permit because that was the only thing that would
change from where council approved the fee changes on February 1, 2024 under ordinance No.2662 and
then they would bring it back before council for a decision.
Mr. Bowman gave the council an explanation of the ordinance. He said that the ordinance to establish
fees for permits and inspections at residential and industrial rates within the city limits of West
Memphis,Arkansas was previously approved by council on February 1, 2024, and assigned ordinance
number 2662. Mr. Bowman said that the only fee that they are asking to be amended is for the
businesses that operate under a temporary enterprise and are issued a certificate of occupancy, there
was typo error in regard to the number of days that a Certificate of Occupancy would cover. It should
have read $50.00 for a period of 30 days instead of$50.00 every 6 months. There being no further
discussion. Councilor Catt made the motion, seconded by Councilor Croom to amend the ordinance.
Upon voice vote, voting was unanimous to amend. Councilor Catt asked about the collections of A& P
sales tax that should be collected from these types of business. Mr. Bowman said that hopefully this
change will help them to be able to track if they are paying their A& P sales tax since they would have to
renew their certificate of Occupancy every 30 days. This would also allow the clerk's office sufficient time
to track if their taxes were submitted in a timely manner. Mr. Bowman said another thing that they are
doing is automating their permitting system and they are needing council's approval of the fees so that
they could integrate them into the system, so that when they make an attempt to get a permit the staff
will get a notification and the staff can ensure that they are paying the correct amount. Councilor Catt
asked if there was an ordinance in place that would prevent them from getting a permit if they have not
submitted their gross receipt taxes.Senior Deputy City Clerk, Patricia Lane explained that there was an
ordinance in place that stipulates that gross receipt taxes are due by the 20th of each month. The clerk's
office has also been coordinating with the permitting office and utilizing code enforcement for
notification of delinquent taxes to bring them into compliance and a 10% penalty is assessed for
outstanding taxes. Councilor Catt made the motion, seconded by Councilor Croom to approve the
ordinance. Mayor McClendon asked for a roll call vote. City Clerk Patricia Joplin called the roll. The roll
call vote was as follows:
YES: Bruce, Catt, Croom, Harris, Holt, Hutchinson, Mohammed Mondy, Murray,
Wheeless
No: None
ABSTENTION: None
ABSENT: None
With 10 yes votes, 0 No votes, 0 Abstention votes,0 absent votes the motion to amend the ordinance
passed. The ordinance was adopted and assigned No. 2669.

ANNOUNCEMENTS:
Mayor McClendon asked Emergency Management Director, Dewayne Rose to provide an update on the
preparation for the Solar Eclipse. Mr. Rose said that they have done a lot of robust planning for the Solar
Eclipse in the last 2 years and in the last 2 months they have gone over multiple disciplines with multiple
States in the planning process. He said although Arkansas and Tennessee are not in the path of the
totality people will travel through Arkansas to get to it.The 1-40 and.l-50 interchange has been heat
mapped by ARDOT and will probably be one of the most congested travel areas next to Pulaski County,
with that said you will see an increase in law enforcement and the Highway Department.ARDOT&TDOT
have started implementing their message boards to inform people of the Solar Eclipse date and warning
them not to park on the shoulders to observe the Eclipse. The Arkansas State Police are going into a 12
hour rotation where they will be having 24 hour coverage throughout Tuesday. They also finalized robust
communication plans this morning with ARDOT and Tennessee that if there is any major incidents on the
bridge that they will be able to mitigate it quickly. The West Memphis Police Department, EMS, Fire will
also have an increased presents and be on an implemented overtime schedule.
Mayor McClendon asked Utility Manager, Bob Atkins to give an update about the Big Cypress ribbon
cutting on April 4, 2024, at 9:00 a.m. Mr. Atkins said the facility is a solar facility constructed by NextERA
Energy. The City of West Memphis will be taking starting in 2025, 20 megawatts of Solar Power out of
that facility. He said we currently have 40 megawatts of cold fire generation with the 2 plants that we are
co-owners in that are scheduled to close. 1 will close in 2028 and the other in 2030,this is preparation
for those plants closing. The city has signed an agreement and we will have rate stabilization from this
deal until 2029. Mr.Atkins said it will bring cost-effective solar energy to our customers. The Solar energy
will generate clean energy
Mayor McClendon commended Jim Jackson and staff for the previous evening event at the Civic
Auditorium. They hosted Circus on Ice on April 18, 2024, he said in the past they have had Gospel
Concerts, Plays, and dance competitions at the auditorium, but it was truly remarkable to see people
skating on ice on the stage.
Mayor McClendon announced that Southland has always been a philanthropy partner with the City of
West Memphis. He said yesterday they named the City of West Summer Youth Program as their Game
Changer recipient and through their generosity and support of the West Memphis Summer Youth Work
Program the city has been given a monetary donation of two checks, they just received the first check in
the amount of$20,694.84 to fund the Summer Jobs program. The mayor said the children gain not only
work experience working in jobs in the City of West Departments but on Fridays they participate in
valuable life skills training workshops. As part of their training in the past he has asked them to come up
with innovative ideas that will help to improve the city and it was one of the participants that presented
the idea of an all-inclusive park for the handicapped. He-said their idea is now a reality and they are now
constructing an All-Inclusive Park at Hicks Park. The mayor said that is why it is important to invest in our
children because they are the future of West Memphis. He thanked OC and his staff, Delaware North
Southland, and the Jacobson family for their support and belief in West Memphis.
Mayor McClendon said he had a meeting at the Chamber of Commerce with ARDOT and TDOT to discuss
the new bridge. There has been talk about building a third bridge but through state law and some
restrictions, if they were to build a third bridge, they cannot just leave the 1-55 bridge. He said that they
have come up with an alternative. There is the possibility of them receiving a grant of over a half billion
dollars to fund a new bridge, although it is not definite. He said he has seen pictures of the plans for the
bridge it would have two lanes and sidewalks and it would not take 30 to 40 years to construct. It would
also tie into the North side of 1-55 which is Crump Boulevard and go all the way down to Bridge Port
Road. He said that there is a lot of support, and they are hoping the Federal Government supports it.The
mayor said he made an emotional plea for the necessity to find funding for the project because of the
impact the bridge has on the city due to the high traffic volume coming through the heart of the city
streets when the bridge is not operational. Mayor McClendon said he plans to be persistent in asking for
help to improve the South Loop area and getting it completed because the city needs it.
Mayor McClendon spoke about several incidents that occurred in the city. One young man was killed on
Resurrection Sunday and another young man was killed last night. He said that it saddens him to know
that these young men's lives have been cut short and one life lost is to many. He is once again asking
parents to get involved. Councilor Harris said that it is going to take prayer and preachers coming out of
the church and hitting the street to pray over the city as well as the city uniting and working together.

Councilor Harris,to adjourn. Upon voice vote, the voting was unanimous. The meeting was adjourned at
