A RESOLUTION TO WAIVE CERTAIN METER AND TAP FEES FROM
FAMILY DOLLAR SERVICES, INC.
WHEREAS, Family Dollar Services, Inc., (FDS) has
entered into a agreement with the City of West Memphis
Public Facilities Board (the " Board") and the City of West
Memphis, Arkansas, (the "City") for the location of a
distribution facility in the industrial park to be known as
Mid-America Center and for the development of the
industrial park; and
WHEREAS, the West Memphis Utility Commission has
recommended the waiver of meter and tap fees for the
connection of water, sanitary sewer and electric utilities
to be provided by the City in consideration of the
commitments and obligations assumed by FDS in connection
with the development of the distribution facility; and
WHEREAS, the City Council of the City of West Memphis,
Arkansas, finds that the recommendation of the West Memphis
Utility Commission is appropriate and should be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, THAT all meter and tap
fees for the connection of water, sanitary sewer and
electric utilities provide by the City of West Memphis be
waived in connection with the development of distribution
facilities to be constructed in the industrial park known
