A RESOLUTION APPROVING THE PURCHASE OF 107.5 ACRES
FROM AP&L FOR THE FLOOD PROTECTION PROJECT.
WHEREAS, the City of West Memphis is desirous of
purchasing 107.5 acres of surplus land as described in the
attached legal description from AP&L for the Flood
~` Protection Project; and

~r- WHEREAS, AP&L is willing to sell the property; and
WHEREAS, the City and AP&L both find acceptable the
McCarley's appraisal of $3,000.00 an acre; and
WHEREAS, AP&L has offered to allow the City to defer
payment until March 31, 1994; and
WHEREAS, AP&L has agreed to allow the City to cut its
railroad spur to their substation; and
WHEREAS, the City understands that in return for
cutting the rail spur it must provide approximately 1,200
tons of crushed limestone for an alternative rail off
loading site;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, THAT:
The City finds the above conditions of purchase
acceptable and authorizes the Mayor and City Clerk to
execute a contractual agreement with AP&L for the purchase
of the property as described in the attached legal
description.

LEGAL DESCRIPTION OF DETENTION POND PROPERTY
A 107.5 acre tract of land lying in the east half of Section 24, Township 6
North, Range 8 East, and the southwest quarter of Section 19, Township 6
North, Range 9 East, Crittenden County, Arkansas, being more particularly
described as follows:
Beginning at a point on the south right-of-way line of the Friday-Graham
Rail Spur; said point lying 610.46 feet from the intersection of the east
right-of-way line of Port Road and the south right-of-way line of the
Friday-Graham Rail Spur, then north 60 degrees 23 minutes 35 seconds east
along said south right-of-way line a distance of 396.51 feet to the center
line of Ditch 20, then south 40 degrees 20 minutes 9 seconds east along the
center line of Ditch 20 a distance of 634.16 feet to a point on the east
line of Section 24, T-6-N, R-8-E, then southward along the east line of
Section 24 a distance 474.06 feet to the east quarter corner of Section 24,
then north 80 degrees 50 minutes 39 seconds east along the east west center
line of Section 19, T-6-N, R-9-E, 707.09 feet, then south 41 degrees 42
minutes 4 seconds east 1,001.85 feet to a point on the land side of the
St.Francis Levee District right-of-way, then along the said right-of-way
south 34 degrees 39 minutes 33 seconds west 1,414.93 feet, then north 54
degrees 51 minutes 55 seconds west 33.00 feet, then south 35 degrees 04
minutes 07 seconds west 516.15 feet, then leaving the St Francis Levee
District right-of-way north 54 degrees 54 minutes 19 seconds west 1,850.77
feet to a point on the east right-of-way of Port Road, then northward along
said right-of-way 288.75 feet, then along a 670.0 foot radius curve; chord
bearing north 80 degrees 34 minutes 41 seconds east, a distance of 270.64
feet to a point on the east right-of-way line of the Arkansas Power & Light
Company's railroad spur to the Friday-Graham Rail Spur; said point being
parallel to and 50 feet east of the center line of said railroad spur
track, then along said right-of-line north 00 degrees 21 minutes 21 seconds
west a distance of 1,215.95 feet, then along a 634.56 foot radius curve to
the right; chord bearing north 60 degrees 10 minutes 49 seconds east, a
distance of 471.66 feet to the point of beginning, containing 107.5 acres
more of less.
Subject to a 15 foot utility easement lying 7.5 feet either side of the
center line of a 16" water line as shown on the plat.
Subject to a 20 foot utility easement lying 10 feet either side of the
center line of a 20" sanitary sewer force main as shown on plat.
Subject to a 33 foot oil products pipe line easement lying 16.5 feet either
side of the center line of an oil products line as shown on the plat.
Subject to a 15 feet AT&T easement lying 7.5 feet either side of the AT&T
line as shown on the plat.
Subject to a 50 foot road easement lying parallel and adjacent to the south
right-of-way line of the Friday-Graham Rail Spur.
Subject to a 20 foot AP&L easement lying parallel and adjace the east
