RESOLUTION NO.
A RESOLUTION PROVIDING FOR NOTICE BY PUBLICATION OF A
REFERENDUM PETITION FILED WITH THE CITY CLERK
REGARDING ORDINANCE 1564 AND SETTING A PUBLIC HEARING.
WHEREAS, pursuant to Amendment 7 of the Constitution of the
State of Arkansas and Ordinance 151 of the City of West Memphis,
a referendum petition has been filed with the City Clerk within
thirty (30) days after the passage of Ordinance 1564; and
WHEREAS, pursuant to Ordinance 151, the City Council is to
give notice by publication for one insertion of a time not less
than five days after the publication of such notice at which
time they will hear all persons who wish to be heard prior to
the City Council's determination whether such petition is signed
by the requisite number of petitioners; and
WHEREAS, pursuant to Ordinance 151, the decision of the
City Council shall be final, unless suit is brought in the
Chancery Court of Crittenden County within thirty days; and
WHEREAS, pursuant to Ordinance 151, if the City Council
finds that' such petition is signed by the requisite number of
,~ petitioners, it shall order a special election to determine by
a vote of the qualified electors whether the ordinance shall
stand or be revoked, which election shall be not less than ten
days after the order therefor has been made by the Council, and
which election shall be had and conducted as general elections
held in the City;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT a public hearing be called

Memphis, Arkansas, for the purpose of hearing all persons who
wish to be heard on the question whether the referendum petition
regarding Ordinance 1564 filed with the City Clerk on January
15, 1993, is signed by the requisite number of petitioners, and
further, that the City Clerk be directed to cause notice of such
,,, public hearing to be given by publication for one insertion of
a time not less than five days before the date scheduled for the
public hearing.

referendum of Ordinance 1564 of the City of West Memphis,
Arkansas, has been filed with the City Clerk of the City of West
Memphis, Arkansas.
A public hearing will be held before the West Memphis City

205 South Redding, West Memphis, Arkansas, at p.m. on
Thursday, March 18, 1993, for the purpose of hearing all persons
who wish to be heard on the question whether such petition is
signed by the requisite number of petitioners.
All persons who wish to be heard are hereby notified to
appear on said date for the purpose of being heard.
