AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE
OF ONE VEHICLE FOR THE WEST MEMPHIS UTILITY COMMISSION,
DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58- ~0 ~ allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS, the West Memphis Utility Commission is in need of purchasing one vehicle
to replace a damaged vehicle; and
WHEREAS, Howard Ford has one 1999 Ford Explorer 4x4 available for immediate sale
and competitive bidding under such circumstances would not be feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following item to be used by the City,
described as follows:
Purchase of one 1999 Ford Explorer 4x4 at a cost of $24,092.00.
2 EMERGENCY CLAUSE. It having been found and determined by the City Council
of the City of West Memphis, Arkansas, that there is an urgent and immediate need by the City of
West Memphis and the West Memphis Utility Commission to purchase one vehicle and that the
above referenced vehicle is available immediately and may not be available at the expiration of 30
days from the passage of this ordinance and that time is of the essence, an emergency is hereby
declared to exist, and this ordinance being necessary for the preservation of the public health,
safety, and welfare of the citizens of West Memphis, Arkansas, shall be in full force and effect
from and atter the date of its passage and approval.
