AN ORDINANCE TO AMEND ORDINANCE NO.2420,SECTION 1,
SUBSECTION 2,GRANTING A SPECIAL USE PERMIT LOCATED AT 1299
KUHN ROAD,ALLOWING FUTURE EXPANSION OF A SANITARY LANDFILL
AND ASSOCIATED ACTIVITIES,IN THE CITY OF WEST MEMPHIS,CVE,
CONSERVATION EXTRA-TERRITORIAL ZONING DISTRICT OF THE CITY
OF WEST MEMPHIS, CRITTENDEN COUNTY,ARKANSAS.
WHEREAS,has application has been made to the City Planning,Commission on
October 26,2016 to allow future expansion of the sanitary landfill and,associated activities, in
the City of West Memphis,CVE,Conservation Extra-Territorial Zoning District, as required by
Ordinance 1988, as amended; and
WHEREAS,after notice had been published for the time and in the manner as provided
by Ordinance No. 1988, as amended,the matter was heard by the City Planning Commission on
Wednesday, October 26,2016 and the Planning Commission recommended a Special Use Permit
be granted to allow future expansion of a sanitary landfill and associated activities, at.1299 Kuhn
Road,located in the City of West Memphis, CVE,Extra-Territorial Zoning District, subject to
the following conditions and attached Site Plan; and
1. During the landfill's operational life and once the landfill has been closed,a pump
system will be used to evacuate water from the soil borrow pits. A gravity drainage
system to the 15-mile bayou could potentially be permitted in the future. If
successfully permitted,the pump system would be abandoned.
2. The permitted maximum elevation of the landfill is 280 FMSL. This elevation will
not increase as part of the proposed expansion.
3. Soil stockpiles will not exceed 30 feet in height.
WHEREAS,the operator of the landfill has requested that the City Council amend
Ordinance No 2420, Section 1, Subsection 2,to increase the permitted maximum elevation of the
landfill; and
WHEREAS,the Federal Aviation Administration(FAA)has approved an increase of the
maximum allowable elevations not to exceed the height of 362 FMSL on the west side of the
landfill and 334 FMSL on the east side of the landfill.
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS,ARKANSAS:
SECTION 1. The following described property,to wit:
Common Address: 1299 Kuhn Road
and the same hereby is granted an amendment to the special Use Permit allowing expansion of a
sanitary landfill and associated activities, at 1299 Kuhn Road,located in the City of Wet
Memphis, CVE Conservation Extra-Territorial Zoning District, subject to the following
conditions and attached Site Plan:
1. During the landfill's operational life and once the landfill has been closed, a pump system
