A RESOLUTION AUTHORIZING LOCAL GOVERNMENT COOPERATIVE
PURCHASING.
WHEREAS, Arkansas' State Purchasin:; Law (A.C.A. 1987 Section
19-1:1-201) was signed into law by Governor Bill Clinton on March
21, 1979; and
WHEREAS, effective J~.rly 1, 1979, Arkansas' State Purchasing
Law provides the opportunity for local public procurement units to
participate in. contracts of the State of Arkansas, Department of
Finance and Administrat_i.on, Office of State Purchasing, for the
purchase of supplies, services, equipment and certain materials;
NOW, THEREFORE, BE IT RESOLVED BY THF' CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
Section 1. That the Mayor of the City- of West Memphis hereby
requests authority in the name of the City of West Memphis to
participate .i_n sta.te contr•act.s which the Department of Finance and
Administration, Off:i.ce of State Purchasing, has entered into for
the purchase of sripplie.s, services, equipment. and certain materials
pursuant t.o t:he State Purchasing Law and Amendment 54 to the
Ar.kansa.s Constitution.
Section 2. That the Mayor of the City of West Memphis is
hereby authorized to agree in the name of the City of West Memphis
t,o be bound by al. l_ contract terms and conditions as the Department
of Finance and _Administration, Office of State Purchasing,
prescribes. Such terms and conditions may include a reasonable fee
t.o cover the administrative costs which the Department of Finance
and Administ;r.at:ion incurs a,s a result o:f the City of West Memphis's
partic,ipat.ion in a contract. Further, that the Mayor of the City
of West Memphis does hereby agree to be bound by a.ll such terms and
conditions.
Section 3. That the Mayor of the City of West Memphis is
hereby authorized t;o agree in t;he name of the City of West Memphis
to directly pay t he vendor, under such state contract in which it
participates, for items it receives pursuant to the contract, and
that the Mayor of the Ctyr of West. Memphis does hereby agree to
directly pa.y the vendor.
