1368RESOLUTION NO.
A RESOLUTION DECLARING CERTAIN STRUCTURES TO BE DANGEROUS
BUILDINGS AND DIRECTING THAT SUCH STRUCTURES BE
IMMEDIATELY REPAIRED, VACATED, OR DEMOLISHED IN ACCORDANCE
WITH CHAPTER 6.04 OF THE WEST MEMPHIS MUNICIPAL CODE.
WHEREAS, Chapter 6.04 of the West Memphis Municipal Code
provides the procedure for the immediate repair, vacation or
demolition of dangerous buildings where it reasonably appears
that there is immediate danger to the life or safety of any
person; and
WHEREAS, all dangerous buildings within the terms of
Chapter 6.04 of the West Memphis Municipal Code are declared to
be public nuisances and shall be repaired, vacated or
demolished as provided in Chapter 6.04 of the West Memphis
Municipal Code; and
WHEREAS, the building inspector has reported to the City
Council that there reasonably appears that there is an
immediate danger to the life or safety of any person with
respect to three structures as described in Exhibit "A"
attached hereto, comprising Criner's Motel located at 35.10 East
Broadway in West Memphis, Arkansas, and has recommended that
two of the structures should be demolished and one structure
should be vacated;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
1. The structures as described in Exhibit "A" attached
hereto located at 3510 East Broadway in West Memphis, Arkansas,
and comprising Criner's Motel, are hereby declared to be
dangerous buildings as defined in Chapter 6.04 of the West
Memphis Municipal Code and to be public nuisances and the City
of West Memphis shall cause the immediate repair, vacation or
demolition of such dangerous buildings in accordance with the
recommended actions set out in Exhibit "A".
2. The costs of such emergency repair, vacation, or
demolition of such dangerous buildings shall be collected in
the same manner as provided in Section 6.04.050 E of the West
Memphis Municipal Code.
