WHEREAS, a lawsuit has been filed by Anthony P. Miler
t
against the City of West Memphis, Arkansas; Leo Chitman;
and William H. Ralph, Jr. for damages in a considerable
amount for alleged violations of 42 U.S.C. 1981, 1983, 1985
(3), 1986, 1988 and the United States Consitiution; and,
WHEREAS, it has been determined by the West Memphis
City Attorney and the Arkansas Municipal League Legal
Defense Fund that it is in the best interests of the City
of West Memphis, Arkansas, to settle such lawsuit; and,
WHEREAS, Anthony P. Miller, through his attorney, G.
Hite McLean, has agreed to settle the lawsuit for a total
amount of $5,500.00, which includes back pay to December 1,
1984 and attorney's fees;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, that the City Council
approves the payment to Anthony P. Miller and G. Hite
McLean, his attorney, in the amount of $5,500.00, to be
paid by a check for the amount of back pay directly to
Anthony P. Miller and a second check for the balance
payable to Anthony P. Miller and G. Hite McLean, his
attorney.
ADOPTED this 2nd day of April, 1987.
