A RESOLUTION AUTHORIZING THE REMOVAL OF DEBRIS FROM
PUBLIC AND PRIVATE PROPERTY AND INDEMNIFYING THE
FEDERAL GOVERNMENT AGAINST ANY CLAIM ARISING FROM SUCH
REMOVAL FROM PRIVATE PROPERTY.
WHEREAS, the tornado of December 14, 1987, caused an
accumulation of debris and wreckage on public and private
property in the City, whic}i debris and wreckage must be
removed; and
WHEREAS, Title 42, Section 5173 of the i_inited States
Code regarding federal assistance for the removal of debris
and wreckage caused by a major disaster requires the
affected local government to first. arrange an unconditional
authorization for the removal of such debris or wreckage
from public and private property, and, in tale case of
removal of debris or wreckage from private property, shall
first agree to indemnify the Federal Government against any
claim arising from such removal;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, that, pursuant. to Title
42, Section 5173, of the United States Code, the removal of
debris or wreckage from public and private property, caused
by the tornado of December 14, 1987, is hereby
unconditionally authorized, and the City of West Memphis,
Arkansas, hereby agrees to indemnify the Federal Government
against any claim arising from the removal of debris or
