AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE REPLACEMENT OF
RADIO TRANSMISSION EQUIPMENT ON CITY WATER TOWERS, DECLARING AN
EMERGENCY, AND FOR OTHER PURPOSES
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of
competitive bidding in exceptional situations where such procedure is deemed not
feasible or practical; and
WHEREAS, the Water Department has installed radio transmission equipment on
all city water towers to relay water levels and flow rates to its operations room; and
WHEREAS, the Water Department uses this information to efficiently and
effectively monitor and control the city-wide water distribution system; and
WHEREAS, the radio transmission system was allowed to fall into disrepair to the
point that only one tower was being monitored; and
WHEREAS, when the Water Treatment Plant was being upgraded this problem
was identified; and
WHEREAS, the Water Department then took immediate steps to correct the
problems by contacting the original installer; and
WHEREAS, the original installer was the only contractor familiar with the Water
Department's system and was likely to be the most economical source for replacing the
system; and
WHEREAS, the Water Department was desirous to reactivate the system as
soon as possible and contracted the work under the impression that it did not need to be
bid out; and
WHEREAS, once the work was completed it was realized that the work should
have been bid out
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS
1. That competitive bidding be waived for the replacement of the radio
transmission system for the city's water towers and that the invoice from Micro-Comm,
Inc. in the amount of $12,020.27 be paid. Competitive bidding is being waived because
the work has already been completed by a contractor who was the sole supplier of the
system and because the system needed to be replaced immediately.
2. EMERGENCY CLAUSE. It having been found and determined by the City
Council of the City of West Memphis, Arkansas, that there is an urgent and immediate
need by the City of West Memphis to pay this invoice for work that has already been
completed, that this work was contracted out in good faith by the Water Department to
correct an urgent need to efficiently and effectively manage the city's water supply, and
the work was performed in an expeditious manner by the original installer on credit with
the expectation of being reimbursed for the work, and this ordinance being necessary for
the preservation of the public health, safety, and welfare of the citizens of West
Memphis, Arkansas, by ensuring future water needs can be met by reliable contractors
shall be in full force and effect from and after the date of its passage and approval.
