A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
SIGN THE ALLEN SITE PRP PARTICIPATION AGREEMENT
WHEREAS, the United States Environmental Protection
Agency has advised the West Memphis Utility Commission
that, along with other entities, it may be a "Potentially
Responsible Party" under the Comprehensive Environmental
Response, Compensation and Liability Act of 1980, as
amended, for conditions at the Allen Transformer Site
located in Fort Smith, Arkansas; and
WHEREAS, it is desirable for the West Memphis Utility
Commission to join with other Potentially Responsible
Parties to address issues common to them involving the
Allen Transformer Site on a joint, cooperative basis; and
WHEREAS, the West Memphis Utility Commission is
scheduled to consider the Allen Site PRP Group
Participation Agreement at the next regularly scheduled
meeting of the West Memphis Utility Commission in order
that it may be executed and returned prior to May 16, 1988;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, that, subject to the
approval of the West Memphis Utility Commission, the Allen
Site PRP Group Participation Agreement is hereby approved ,
and the Mayor and the City Clerk are hereby authorized to
execute said Agreement.
