A RESOLUTION SUPPORTING THE HANDICAPPED PERSONS
ACCESS TO PARKING ACT OF 1985, A3 AMENDED, AND
ENCOURAGING ALL PERSONS DOING BUSINESS WITH THE
PUBLIC IN THE CITY TO BE FAMILIAR WITH AND
COMPLY WITH THE REQUIREMENTS OF THE ACT.
WHEREAS, the State of Arkansas has adopted the
Handicapped Persons Access to Parking Act of 1985, as
amended, which requires public and private agencies to
provide specially designated and marked motor vehicle
parking spaces for the exclusive use of handicapped persons
who have been issued a special handicapped person motor
vehicle decal or special certificate; and
WHEREAS, after July 1, 1988, the required designation
for handicapped parking spaces shall be the sign R7-8
listed in the Manual of Uniform Traffic Control Devices
(Rev. 12/79), as illustrated in the attachment hereto; and
WHEREAS, there are many locations in the City of West
Memphis where handicapped parking spaces are either not
available or not properly designated; and
WHEREAS, the Act provides penalties for the operators
of vehicles parked illegally in spaces designated for the
exclusive use of handicapped persons; and
WHEREAS, the Police Commission has recommended that the
provisions of the Act be enforced;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, that all persons doing
business with the public in the City and all operators of
motor vehicles are encouraged to be familiar with and
comply with the Handicapped Persons Access to Parking Act
of 1985, as amended.
