AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR THE
PURCHASE OF COMPUTER EQUIPMENT AND SOFTWARE FOR THE
WEST MEMPHIS MUNICIPAL COURT, DECLARING AN
EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, it has been necessary to upgrade the existing computer hardware and
software in the West Memphis Municipal Court in order to be "Y2K" compatible; and
WHEREAS, the Municipal Court has contacted the original supplier of its computer
equipment and software to provide the upgrade and to make certain the upgraded equipment and
software is compatible with the Municipal Court's existing equipment and software; and
WHEREAS, it would not be feasible or practical to require competitive bidding to
accomplish the necessary upgrade of the Municipal Court computer equipment and software;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. Competitive bidding is hereby waived for the purchase of the computer
equipment and software as set out in Exhibit "A" from Coastline Micro in the amount of
$15,815.00.
SECTION 2. EMERGENCY CLAUSE. It having been found and determined by the
City Council of the City of West Memphis, Arkansas, that an urgent and immediate need exists to
upgrade the computer equipment and software in the West Memphis Municipal Court in order to
be "Y2K" compatible, an emergency is hereby declared, and this ordinance being necessary for
the preservation of the peace, health, safety and welfare of the citizens of West Memphis,
Arkansas, shall be in full force and effect from and after the date of its passage and approval.

Most of our existing hardware and software purchased with MCMS in
Jonesboro in 1989, had to be upgraded !or "Y2K". Not all of our
hardware had to be replaces, but the software had to be upgraded
in order to be compatible. Pal and I discussed this at length,
and our major concern was that with the ^Y2K° problems that are
antlclpated, we felt it necessary to rely on MCMS to handle this
matter.
