A RESOLUTION AUTHORIZING THE MAYOR AND THE CITY
ATTORNEY TO SIGN A CONSENT DECREE BETWEEN THE UNITED
STATES OF AMERICA AND THE CITY OF WEST MEMPHIS AND WEST
MEMPHIS UTILITY COMMISSION, AMONG OTHERS, REGARDING THE
ALLEN TRANSFORMER COMPANY SITE IN FORT SMITH, ARKANSAS.
WHEREAS, the U. S. Environmental Protection Agency
(EPA) acting pursuant to the Comprehensive Environmental
Response, Compensation and Liability Act of 1980, as
amended, has conducted a removal action at the site of the
Allen Transformer Company in Fort Smith, Arkansas; and
WHEREAS, the EPA has cited the West Memphis Utility
Commission, among others, as a potential responsible party
for the costs incurred in the removal action; and
WHEREAS, a Consent Decree has been negotiated between
the participating potential responsible parties and the EPA
to settle the claims of the EPA, to provide contribution
protection and to provide a conditional release;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, THAT the Consent Decree
regarding the EPA removal action at the Allen Transformer
Company site is hereby approved and the Mayor and the City
Attorney are authorized to sign the Consent Decree on
behalf of the City of West Memphis, Arkansas.
