AN ORDINANCE VACATING WHEELER STREET
IN THE CITY OF WEST MEMPHIS, ARKANSAS
WHEREAS, a petition was duly filed with the City Planning

Commission of West Memphis, Arkansas, on the 11th day of
October, 1999, to vacate a portion of the street running
through that part of Wheeler Street which runs across the
south part of Lot 1 and a portion of Lot 2 in the replat First
Addition Regency Subdivision and that part of Wheeler Street
which runs adjacent to the north line of Lot 11 Block 19 of
Wheeler Subdivision as shown in plat book 2 page 113 and 114
in the office of the Recorder of Crittenden County, Arkansas
in the City of West Memphis, Arkansas, as hereinafter more
particularly described; and
WHEREAS, after due notices as required by law, the City
Planning Commission, at the time and place mentioned in the
notice, heard all persons desiring to be heard on the question
and recommended that the petition be approved and that the
portions of the street hereinafter described have heretofore
been dedicated to the public's use; have not been actually
used by the public generally for a period for at least five
years subsequent to the filing of the plat whereby they were
dedicated; that petitioners are the sole owners of the
property abutting upon the portions of the street to be
vacated; and that public interest and welfare will not be
adversely affected by the abandonment of such portions of the
street.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
Section 1. The City of West Memphis hereby releases,
vacates and abandons all its rights, together with~the rights
of the public generally subject only to existing utility
easements, in and to the portions of the street described as
follows:
That part of Wheeler Street which runs across the
south part of Lot 1 and a portion of Lot 2 in the
replat First Addition Regency Subdivision and that
part of Wheeler Street which runs adjacent to the
north line of Lot 11 Block 19 of Wheeler Subdivision
as shown in plat book 2 page 113 and 114 in the
office of the Recorder of Crittenden County,
Arkansas.
Section 2. A copy of this ordinance duly certified by
the City Clerk shall be filed in the office of the Recorder of
Crittenden County, Arkansas, and recorded in the deed records
of the County.

NOTICE is hereby given that a petition has been filed
with the City Council of the City of West Memphis, Arkansas,
by Lodging Development & Management, Inc., and Mark Hale
~ petitioning the said City Council to vacate the following
street:
That part of Wheeler Street which runs across the
south part of Lot 1 and a portion of Lot 2 in the
replat First Addition Regency Subdivision and that
part of Wheeler Street which runs adjacent to the
north line of Lot 11 Block 19 of Wheeler Subdivision
as shown in plat book 2 page 113 and 114 in the
office of the Recorder of Crittenden County,
Arkansas.
All persons are hereby notified and advised that the City
Council of the City of West Memphis, Arkansas, will hear said
petition and determine whether the street hereinabove
specifically described shall be vacated at a meeting of said
City Council to be held on the 4th day of November, 1999, at
1:30 p.m.
