AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR THE
PROPERTY LOCATED AT 400 SOUTH 21st STREET, ALLOWING A
DAYCARE FACILITY IN A R-2, LOW DENSITY RESIDENTIAL DISTRICT.
WHEREAS, application has been made to the City Planning Commission for a
Special Use Permit allowing a daycare facility in a R-2, Low Density Residential District,
as required by Ordinance No. 1988, as amended.
WHEREAS, after notice had been published for the time and in the manner as
provided by Ordinance No. 1988, as amended, the matter was heard by the City Planning
Commission on Wednesday, August 29, 2007 and the Planning Commission
recommended that a Special Use Permit be granted to allow a daycare facility at 400
South 21st Street, located in a R-2, Low Density Residential District, with the following
criteria:
1. The maximum number of children is (10) ten;
2. Must meet all state and local permitting requirements.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNSEL OF
THE CITY OF WEST MEMPHIS ARKANSAS:
SECTION 1: The following described property, to wit:
400 South 21st Street
Lots 1, 2, and 3, Block 178, Kendal Subdivision
and the same hereby is granted a Special Use Permit allowing a daycare facility at 400
South 21st Street, located in a R-2, Low Density Residential District, with the following
criteria:
1. The maximum number of children is (10) ten;
2. Meet all state and local permitting code requirements.
SECTION 11: That all ordinances or parts of ordinances in conflict herewith are
hereby repealed.
