AN ORDINANCE TO AMEND SECTION 3 OF ORDINANCE 1501, TO SET
GARBAGE COLLECTION FEES, AND TO ABOLISH ORDINANCE 1552,
DECLARING AN EMERGENCY AND FOR OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS, ARKANSAS:
SECTION 1. Section 3 of Ordinance 1501, codified as Section 8.04.130 of the
West Memphis Municipal Code, is hereby amended to read as follows:
USERS FEES:
There will be a users fee of twenty dollars ($20.00) per cubic yard per container
up to a maximum fee of one hundred seventy five ($175.00) per container for the period
of January 1 S` through December 31st of each year for commercial pickup by a private
firm.
Each container must be registered with the City Clerk's Office which will issue a
sticker which must be displayed on each container in such a manner that it may be
checked by the utility meter readers. A fine of five hundred dollars ($500.00) per
container shall be charged, in addition to the users fee, if a container is found not
registered with the City Clerk's Office.
The users fee is due on January 1st of the year service will be provided, and
shall be based on the customers being serviced at the time the fee is due. The users fee
must be accompanied by a list of dumpsters, including the size and location of each
container. The users fee shall be considered delinquent on January 31 S`, and the
$500.00 fine shall be assessed on that date on each container not properly registered
with the City Clerk's Office.

EMERGENCY CLAUSE: It having been found and determined by the City
Council of the City of West Memphis, Arkansas, that there is an urgent need to amend
its garbage rates as a result of increased landfill fees and that time is of the essence, an

emergency is hereby declared to exist, and this Ordinance being necessary for the
preservation of the public peace, health, safety, and welfare of the citizens of West
Memphis, Arkansas, shall be in full force and effect from and after January 8, 2004, and
shall apply to all billings after January 8, 2004.
