AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR THE
PROPETY LOCATED AT 406 SOUTH AVALON, TO ALLOW A FLAG
POLE COMMUNICATION TOWER, 160 FEET IN HEIGHT, IN A C-1,
GENERAL COMMERCIAL DISTRICT.
WHEREAS, application has been made to the City Planning Commission for a

Special Use Permit, to allow the construction of flag pole communication tower, 160 feet
in height, in a C-1, General Commercial District, as required by Ordinance 1988, as
amended.
WHEREAS, after notice had been published for the time and in the manner as
provided by Ordinance No. 1988, as amended, the matter was heard by the City Planning
Commission on November 28, 2007 and the Planning Commission recommended that a
Special Use Permit be granted to allow the construction of a flag pole communication
tower, 160 feet in height, in a C-1, General Commercial District, subject to the following
criteria:
1. Comply with FAA regulations;
2. The American Flag to be maintained by Tower Ventures V, LLC.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
SECTION 1: That the following described property, to wit:
Address: 406 South Avalon
and the same hereby is granted a Special Use Permit allowing the construction of a flag
pole communication tower, 160 feet in height, subject to the following criteria:
1. Comply with FAA regulations;
2. The American Flag to be maintained by Tower Ventures V, LLC.
SECTION II: That all ordinances or parts of ordinances in conflict herewith are
hereby repealed.
