AN ORDINANCE GRANTING A SPECIAL PERMIT USE FOR 354 AFCO RAAD,
WEST MEMPHIS, ARKANSAS, FOR THE CONSTRUCTION OF A RADIO
TRANSMISSION TOWER, 210 FOOT IN HEIGHT, TO SERVICE THE CFfITTENDEN
COUNT~-COMMUNICATION CENTER AND DECLARING AN EMERGENCY AND
FOR OTHER PURPOSES.
WHEREAS, application has been made to the City Planning commission to allow a
Special Permitted Use for the construction of a 210 foot tall radio transmission tower, at 354
Afco Road, West Memphis, Arkansas, as required by Ordinance No.1258, as amended.
WHEREAS, after notice had been published for the time and in the manner as provided
by Ordinance No. 1258, as amended, the matter was heard by the City Planning Commission and
the Planning Commission recommended that a Special Use Permit be granted to said property to
permit the construction of a 210 foot tall radio transmission tower, at 354 Afco Road, West
Memphis, Arkansas, subject to the special conditions as follows:
1. A letter of approval for this site from the Federal Aviation Administration, for this site,
to be presented to Planning staff.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
SECTION 1: That the following described property, to wit:
354 Afco Road, West Memphis, Arkansas
be, and the same is hereby, granted a Special Use Permit allowing and permitting the construction
of a 210 foot tall radio transmission tower, with the special conditions as follows:
1. A letter of approval for this site from the Federal Aviation Administration, for this site,
to be presented to Planning staff.
SECTION II: That all Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
SECTION HI: EMERGENCY CLAUSE. It having been found and determined by the
City Council of the City of West Memphis, Arkansas, that there exists an urgent need to begin
construction of a radio transmission tower at 354 Afco Road, West Memphis, Arkansas, in order
that it may be in place to serve the Communications Center of the Crittenden County Detention
Facility without unnecessary delay and to provide for the safety of the citizens of Crittenden
County and to further provide for the orderly growth and development of the City of West

Memphis as proposed by the Planning Commission, an emergency is hereby declared to exist, and
this ordinance being necessary for the preservation of the public peace, health, safety and welfare
of the citizens of West Memphis, Arkansas, it shall be in full force and effect from and after the
date of its passage and approval.
