Mayor Dacus next announced that the meeting was now open for discussion on a building permit issued to A, L. Butler to move a commercial building from Broadway to the residential zone on S. 11th Street, and that the Council on April 14th had refused the approval of the permit when a group of citizens appeared before the Council to protest the moving of the building due to it being 20 feet wide and buildings on 25 foot lots are restricted to 19feet width, also that the building was in a dilapidated condition and unfit for human habitation. Thereupon, Mr. S. L. Sims presented the following petition to the Mayor and Councils PETITION We, the undersigned citizens of West Memphis, Arkansas, residing on South Tenth, Eleventh and Twelfth Streets, wish by this means to interpose by our strenuous objection of the placing and locating of a wooden store building on South Eleventh Street, in the City of West Memphis, Crittenden County, Arkansas, and have affixed our signatures hereto. We feel that the location of this frame building is a detriment to all surrounding homes and is not a fit and proper building to be located in the residential section, and that the location of said building will decrease the value of homes built and occupied by the undersigned. Troy Denton of the Memphis-West Memphis Transit Company also appeared before the Council to offer the services of his Company to the City. :;after all parties had presented their positions, it was pointed out that the West Memphis ~'ansportation Company had violated all of the provisions of Ordinance No. 133;"that the agreement entered into on December 9, 1948, had likewise been violated, and that either or any of these reasons would be sufficient to revoke the Ordinance, but it was the consensus of opinion that they should be given another opportunity to attempt to furnish a transit system for the City of Pest Memphis and to see if they could comply with the Ordinance and furnish the type of service required by Ordinance No. 133 or a similar Ordinance. It was first discussed that they be permitted to operate without franchise for a period of ninety (90) days to ive them an opportunity to demonstrate their ability to furnish an adequate bus system for West ~mphie and to further see if they could and would comply with the provisions of their original agreement with the City, and at the end of ninety (90) days, if they have indicated their ability to provide an adequate service that they then be given a Franchise and other methods were also discussed in an attempt to work out some solution to the problem. After a discussion of the various means and methods whereby the matter might be continued on some basis acceptableto the City, it was then decided to grant the West Memphis Transportation Company a Franchise for a flat ninety (90) days with the understanding that if the Franchise was not fully complied with and all of its provisions strictly followed-that the grant would end ipso facto July 21, 1949; however, if it was fully complied with that it would be continued. Alderman Manchester then moved that said ordinance be now placed upon its final adoption; motion was seconded by Alderman Garrison, and after due consideration thereof by said Council, the Mayor put the question on the adoption of the motion, and upon the roll being called, the following voted= Aye: Curtis Foster, James Bledsoe, P. B. Powers, A. R. ~`anchester, 0. I. Bollinger, and R. L. Garrison. Nay: None. Whereupon the Mayor declared the motion duly carried and said ordinance placed upon its final reading and adoption. Said ordinance was read in full by Alderman Bollinger, who moved its adoption, seconded by Alderman Manchester, and after due consideration thereof by said Council, the Mayor put the question upon the adoption of said motion, and upon passage of said ordinance, and the roll being called, the following voted: Ayes Curtis Foster, James Bledsoe, P. B. Powers, A. R. Manchester, 0. I. Bollinger, and R. L. Garrison. Nay: None.
