ORDINANCE NO._ I~a~
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE
REPAIR OF THE WEST MEMPHIS UTILITY COMMISSION'S JOHN
DEERE 690D TRACKHOE.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving
of competitive bidding in exceptional situations where such procedure is deemed
not feasible or practical, and
WHEREAS, the West Memphis Utility Commission's John Deere trackhoe
is inoperative due to a failure of its tracking equipment, and
WHEREAS, the West Memphis Utility Commission is desirous of
maintaining the integrity and reliability of its John Deere trackhoe by having it
repaired by a manufacturer trained and authorized service center, and
WHEREAS, there is only one such center in the Mid-South area, that being
Barton Equipment Company in Memphis who can repair the trackhoe for
$11,585.28 plus the cost of any unexpected welding and removal of broken bolts,
and
WHEREAS, the West Memphis Utility Commission bought the trackhoe
from Barton Equipment Company and knows them to be a reputable dealer and
service center, and
WHEREAS, it would be impractical to bid out such service, and
WHEREAS, the trackhoe is in good shape otherwise and could provide
many more years of service, and
WHEREAS, a new trackhoe would cost over $150,000 and a comparable
used trackhoe would cost over $70,000.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF WEST MEMHIS, ARKANSAS:
That competitive bidding be waived for the repair of the West Memphis
Utility Commission's John Deere 690D trackhoe by Barton Equipment Company
of Memphis for the cost of $11,585.28 plus the cost of any unexpected welding
i_ '
and removal of broken bolts. Competitive bidding is being waived because Barton
Equipment Company is the only John Deere authorized service center in the
Mid-South and no other bids would be received and because it is in the interest
of the citizens of West Memphis for the West Memphis Utility Commission to
have its trackhoe operational and available to make repairs to the Commission's
water and sewer system by the time warmer weather comes and such repairs
increase in frequency and urgency.
PASSED AND APPROVED this ~l day of ~ PR ~ L_ , 2000.
