JULY 21t, 1950 The Honorable P,lt?. Dacus I;rayor West Idemphis, Arkansas The nevr Federal rent control law-the Housing and Rent Act of 1950-contains several important changes which I tho:.ght you might like to have called to your attention. r 1. The Duration of Federal Rent Control 19hile the new Act continues Federal rent control an _ e ice o e ousing xpe iter to June 30, 1951, it contains this important new provision: Any incorporated city, town or village that wishes to continue Federal rent control beyond December 31 of this year must take affirmative action to tyre end prior to that date, Such affirmative action can be taken either by a resolution passed by the local governing body o r by popular referendum, declaring that a shortage of rental housing; accoi:uaodations exists which requires the continuance of rent control beyond December 31, 1950. In t;.e absence of such affirmative action by your governing body. Federal rent control will automatically terminate in your community on December 31, 1950. If the incorporated localities taking such affirmative action constitute the n.ajor portion of the defense rental area, rent controls will be continued in the unincorporated localities in the rer.:ainder of the area then under control, 11. The 1.4atter of Local Option, As you know, under the previous Act an incorpora ci y, own or vi age ad the authority to decontrol itself by following specified procedure;;, including the holding of a puolic hearing after ten days notice, adoption by the governing body of a resolution finding that rent control was no lonE,er necessary and approval of such action by the Governor. The present Act makes two changes in the local option provision; (1) It extends the decontrol authority to the unincorporated area of any county (instead of lusting it to the incorpor:aed cities, tovms or villages in a county) (2) The Governors approval of a local option resolution is -io longer required; in other works, action by the local governing boar is final and binding on the Housing Expediter if the procedures outlined in the Act hove been followed. As you know, it is rgyy responsibility under the Act to end rent controls on r;y own initiative in an area or part of an area as soon as the demand for rental housing has been reasonably met. In order that I may act intelligen tly to fmlfill this responsibility, the Office of the Housing Expediter will continue to collect basic housing data for all important areas under rent control. 1u7ienever we have completed a housing survey of a particular area or city, I shall send a copy of the survey to tt,e local rent advisory board and at the satae tine I vrill advise the local governing body drat such a survey has been completed, that a copy of it has been sent to the local rent advisory board, and a copy of the survey is available for the local municipal authorities. If you have any questions concerning the new Act, especially in its relation to you, I shall be most happy to answer them, Sincerely yours, 5/ Tighe E. 'v'Joods Housing Expediter After discussicn of the r.:atter, the City Attorney was instructed to prepare a notice to be publistred in the local papers advising of a public hearing on rent control at the r'ru;;-ust 15th meeting of the Council. The following petition eras prevented to the Council; }"ie, the undersigned, being owners in fee siruple of real estate located in a plat of ground, as shovm by map attached hereto, vh ich is contiguous acid adjoins the City of 1Vest P,~eimphis; and we being desirous of having said lands incorporated into or annexed to the City of Viest i!iemplris, here:ry petition the County Court of Crittenden County, Arkansas, and request that an order be made anne~d.ng or incorporating said lands into the City of tiV-est i~eriphis, Arkansas. A report was made by Engineer Byrd on the Wheeler Subdivision Plat. He pointed out that the corners of the lots and blocks were not established and this would result in confusion when the property was developed and being used; that the corners of lots and blocks s}could be established and nwnbered for future reference. With this exception the plat was properly prepared and should be recorded. Llotion was made, passed and adopted that the plat be approved subject to the correct~_ons hereinabove stated. Also, several plans were submitted for the employment of an additional fireman in order that a man would be on duty 2lG hours a day. After a discussion of the matter it was thougi,t best to defer action until a later date. The Counc:il~s attention was called to the fact that numerous accidents are occurring at street intersections; that there are few stop signs at the various intersections, and there is no Ordinance regulating the flow of traffic. PGotion was n!ade, passed and adopted to purchase a sufficient rnimber of stop signs and to have them installed at all street intersections. The City Attorney was instn_rcted to prepare the necessary Ordinance to regulate said traffic. ?s. Jim Bailey, Superintendent of the Garbage Department, reported to the Council that a new truck chassis was urgentl3• needed for the old garbage truck. After discussion, City Engineer Byrd was instructed to advise the local tz~aclc dealers that bids would be received for a 2-ton truck chassis at the August 15th meetin0, of the Council. A number of complaints was made to the Council as to the disorderliness of the patrons leaving the Joy Theatre after the late shows and also the type of stage shows note being presented.
