AN ORDINANCE PROVIDING FOR A SPECIAL PERMITTED USE WITHIN
AN C-2, OPEN DISPLAY COMMERCIAL DISTRICT IN THE CITY OF
WEST MEMPHIS, CRITTENDEN COUNTY, ARKANSAS.
WHEREAS, application was made to the City Planning
Commission for a special permitted use of the hereinafter
described property to conduct auctions, and after notice
having been published for the time and in the manner as
provided by Ordinance No. 715, as amended, the matter was
heard by the City Planning Commission, and the Planning
Commission recommended that the application be approved
subject to the following oonditions as amended by the City
Council:
1. Sales to be limited to truck, truck trailer and
related equipment;
2. No long term storage, all property intended for the
sale is not to be stored on the lot longer than
three (3) weeks prior to the sale and one (1) week
after the sale;
3. Additional screening with evergreen trees along the
southern boundary.
4. The special permitted use be granted to Southland
Racing Corporation, its lessees, subsidiaries,
successors, and assigns and shall not run with the
land.

granted subject to the conditions as amended by the City
Council; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS, ARKANSAS:

SECTION I: That the following described property located
in the city of West Memphis, Crittenden County, Arkansas, to
wit.
All that part of the SE1/4, SW1/4, of Section 5 an•3
all of the fractional part of the NE1/4 SW1/4 of
Section 5 south of the Missouri-Pacific Railroad
right-of-way all in T-6-N, R-9-E, City of West
Memphis, Crittenden County, Arkansas containing
77.17 acres more or less.
be, and the same granted a special permitted use within a C-2,
Open Display Commercial District to conduct auctions.
SECTION II: That all ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION III: This Special Use Permit is specifically
conditioned upon the restrictions as mentioned above.
