AN ORDINANCE APPROVING THE HIRING OF WEST MEMPHIS
POLICE OFFICERS TO ASSIST THE BAILIFFS IN THE WEST
MEMPHIS DISTRICT COURT, DECLARING AN EMERGENCY AND
FOR OTHER PURPOSES.
WHEREAS, A.C.A. §14-42-107(b)(1) states:
No alderman, council member, official, or municipal employee shall be interested,
directly or indirectly, in the profits of any contract for furnishing supplies,
equipment, or services to the municipality unless the governing body of the city
has enacted an ordinance specifically permitting aldermen, council members,
officials, or municipal employees to conduct business with the city and
prescribing the extent of this authority.
and;
WHEREAS, the City of West Memphis desires to utilize grant funding to hire members
of the West Memphis Police Department to assist the bailiffs in the West Memphis District Court
subject to certain conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. The City of West Memphis is hereby authorized to hire members of the
West Memphis Police Department to provide services to the West Memphis District Court to
assist the bailiffs in the District Court, provided:
a) No individual shall be hired for such purposes without prior written authorization of
the Mayor; and
b) No individual shall be hired to perform such services during that individual's normal
working hours with the West Memphis Police Department.
SECTION 2. EMERGENCY CLAUSE. It having been found and determined by the
City Council of the City of West Memphis, Arkansas, that an urgent and immediate need exists
to provide additional security in the West Memphis District Court and that the passage and
approval of this ordinance is necessary to have these additional personnel in place immediately,
an emergency is hereby declared, and this ordinance being necessary for the preservation of the
peace, health, safety and welfare of the citizens of West Memphis, Arkansas, shall be in full force
and effect from and after the date of its passage and approval.
