AN ORDINANCE APPROVING THE HIRING OF MEMBERS OF THE
WEST MEMPHIS POLICE DEPARTMENT AND THE WEST MEMPHIS
FIRE DEPARTMENT AND OTHER CITY EMPLOYEES TO PERFORM
CUTOFF SERVICES FOR THE WEST MEMPHIS UTILITIES AND FOR
OTHER PURPOSES.
WHEREAS, A.C.A. §14-42-107(b)(1) states:
No alderman, council member, official, or municipal employee shall be interested,
directly or indirectly, in the profits of any contract for furnishing supplies,
equipment, or services to the municipality unless the governing body of the city
has enacted an ordinance specifically permitting aldermen, council members,
officials, or municipal employees to conduct business with the city and
prescribing the extent of this authority.
and;
WHEREAS, the City of West Memphis desires to hire members of the West Memphis
Police Department and members of the West Memphis Fire Department and other city employees
to provide cutoff services for the West Memphis Utilities, subject to certain conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. The City of West Memphis is hereby authorized to hire members of the
West Memphis Police Department and members of the West Memphis Fire Department and
other city employees to provide cutoff services for the West Memphis Utilities, provided:
a) No individual shall be hired for such purposes without prior written authorization of
the Mayor; and
b) No individual shall be hired to perform such services during that individual's normal
working hours with the West Memphis Police Department or the West Memphis Fire
Department or the City of West Memphis.
