AN ORDINANCE GRANTING A SPECIAL PERMITTED USE FOR THE
PLACEMENT OF A MONOPOLE TRANSMISSION TOWER AND EQUIPMENT
SHELTER FOR A BELL SOUTH MOBILITY CELLULAR PHONE SITE. THE
LOCATION OF THE SITE IS LOT 3-C OF THE McCAIN SQUARE PLANNED UNIT
DEVELOPMENT, LOCATED AT 224 McCA1N BLVD., WEST MEMPHIS,
ARKANSAS, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, Application was made to the City Planning Commission of West
Memphis, Arkansas, to allow a Special Permitted Use of the hereinafter described lands
for the construction of a Monopole Transmission Tower And Equipment Shelter (per
Zoning Ordinance No. 1258, as amended); and
WHEREAS, Notice of said hearing has been published for the time and in the
manner as provided by Ordinance No. 1258, the matter was heard by the City Planning
Commission on February 28, 1996, and upon the matter being heard by the City Planning
Commission recommended that said Application be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
Section I: That the following described property, to wit:

McCain Square Planned Unit Development
224 McCain Blvd.
West Memphis, Arkansas
be, and the same is hereby, granted a Special Permitted Use allowing and permitting the
use of the aforedescribed property for the construction of a monopole transmission tower
and equipment shelter thereon in a Planned Unit Development District.
Section II: That all Ordinances or parts of Ordinances in conflict here with are hereby
repealed.
Section III: EMERGENCY CLAUSE: It is found and declared by the City Council
of the City of West Memphis that this communication facility is needed by the community
to provide a greater service area for the community and therefore this ordinance must be
effective immediately. It is recognized the demand by the community for greater service
area is necessary for the safety, health, protection, and welfare of the citizens of West
Memphis, therefore, an emergency is hereby declared to exist and this ordinance shall be
in full force and effect from and after its passage and approval.
