AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR UPGRADING THE
SCADA MASTER COMPUTER SYSTEM, AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS, there are many items necessary for the City's use where competitive bidding is
deemed not feasible or practical; and
WHEREAS, the City of West Memphis and the West Memphis Utilities are in need of
upgrading the existing C3-ilex 9000 hardware, software and services for the SCADA Master System to
EOScada System; and,
WHEREAS, the hardware, and software for the SCADA Master System presently in use is the
exclusive work product of C3-ilex, LLC, and competitive bidding under such circumstances would
not be feasible or practical;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following item to be used by the City, described
as follows:
Upgrade existing C3-ilex 9000 SCADA Master Station with Windows XP based
EOScada System, at the proposed cost of $46,000.00, plus applicable taxes, shipping and
handling charges C3-ilex, LLC of Fremont, California.
2. The agreement between the City of West Memphis and C3-ilex, LLC is hereby approved and the
Mayor and City Clerk are hereby authorized to execute this agreement.
