ORDINANCE NO. OL 7T2
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE REPAIR OF THE
PARK DRIVE BRIDGE,DECLARING AN EMERGENCY AND FOR OTHER
PURPOSES.
WHEREAS,Arkansas Code Annotated Section 14-58-303 allows waiving of
competitive bidding in exceptional situations where such procedure is deemed not feasible or
practical; and
WHEREAS,the Park Drive Bridge is a vital component of the City's transportation
infrastructure and provides essential access for residents, emergency services,school
transportation,businesses, and the traveling public; and
WHEREAS,the bridge has deteriorated to the point that immediate repairs are necessary
to restore its structural integrity and safely reopen the bridge to the public; and
'WHEREAS,delaying the commencement of construction in order to complete the
competitive bidding process would unnecessarily postpone the restoration of this critical public
infrastructure and would not be in the best interest of the citizens of West Memphis; and
WHEREAS,Chris-Hill Construction Company LLC successfully completed the repair
of the Rich Road Bridge for the City of West Memphis in 2025,demonstrating exceptional
workmanship,professionalism, and the ability to complete complex bridge construction projects

in a timely and efficient manner; and
WHEREAS,because of its proven experience, familiarity with the City's bridge
infrastructure, and ability to mobilize quickly,the City finds that Chris-Hill Construction
Company LLC is uniquely qualified to perform the required repairs to the Park Drive Bridge;
and
WHEREAS, Chris-Hill Construction Company LLC has submitted a proposal to
complete the Park Drive Bridge Repair Project for a lump-sum price of One Million Two
Hundred Thirty-Two Thousand Four Hundred Fifteen Dollars($1,232,415.00); and
WHEREAS,the City Council finds that exceptional circumstances exist and that
waiving competitive bidding pursuant to Arkansas law is in the best interest of the City.
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS,ARKANSAS:

SECTION 1:The City Council hereby finds that exceptional circumstances exist making
the competitive bidding process impractical and not in the best interests of the City.Accordingly, •
competitive bidding is hereby waived for the Park Drive Bridge Repair Project.
SECTION 2: The Mayor is hereby authorized and directed to negotiate, execute, and
enter into a contract with Chris-Hill Construction Company LLC for the repair of the Park
Drive Bridge in the amount of$1,232,415.00,together with such documents as may be necessary
to complete the project.
SECTION 3:EMERGENCY CLAUSE.It is hereby found and determined that the
immediate repair of the Park Drive Bridge is necessary as stated herein for the preservation of
. public peace,health, safety, and welfare. Therefore, an emergency is declared to exist, and this
Ordinance shall be in full force and effect immediately upon its passage and approval.
All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of any
