AN ORDINANCE GRANTING A SPECIAL PERMITTED USE FOR TWO CONTIGUOUS PARCELS OF
LAND LYING EAST OF CLUB ROAD AND NORTH OF U.S. HIGHWAY 70 CONTAINING 5.38
ACRES, MORE OR LESS WITH A COMMON ADDRESS OF 3950-4000 E. SERVICE ROAD, WEST
MEMPHIS, ARKANSAS.
WHEREAS, Application was made to the City Planning Commission of West
Memphis, Arkansas to allow a Special Permitted Use of the hereinafter
described lands for the development of a Multi-Family Apartment Complex (per
Zoning Ordinance 1258, as amended); and
WHEREAS, Notice of said hearing has been published for the time and in
the manner as provided by Ordinance 1258, the matter was heard by the City
Planning Commission at the April 24, 1996 meeting and upon the matter being
heard by the City Planning Commission and further consideration thereof the
City Planning Commission recommended that said Application be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS, ARKANSAS:
SECTION I: That the following described property, to wit:
Lot 1, Park Plaza Subdivision to the City of West Memphis, as shown by plat
recorded in plat book 4, page 163, in the office of the circuit Court Clerk &
Ex-Officio Recorder of Crittenden County, Arkansas containing 2.86 acres more
~ or less and a 2.52 acre tract of land lying in the SE1/2 of Section 9, T-6-N,

R-9-E, Crittenden County, Arkansas and being more particularly described as
follows: beginning at the S.E. corner of Lot 1, Park Plaza Subdivision to the
City of West Memphis, as shown by plat recorded in Plat Book 4, page 163,
thence N67 degreesl5'S9" W along the south line of said Lot 1 a distance of
327.88 feet, thence SO1 degree 04'00"E a distance of 431.04 feet, thence N89
degrees 10'39"E a distance of 300.00 feet to a point on the west line of Lot
2, Park Plaza Subdivision, thence NO1 degree 04'00"W a distance of 300.00 feet
to the point of beginning being the same as 3950-4000 E. Service Road, West
Memphis, Arkansas.
be, and the same is hereby, granted a Special Permitted Use allowing and
permitting the use of the aforedescribed property for the development of a
Multi-Family Apartment Complex to be constructed thereon in a C-2 Open Display
Commercial District.
SECTION II: That all Ordinances or parts of Ordinances in conflict herewith
are hereby repealed.
